베트남 노동관계법 변화에 대한 법적 고찰 - 2021년 개정 노동법 및 노동조합법 개정안을 중심으로 -

Vietnam enforced the 6th amended Labor Code, starting January 1, 2021 and has spurred the amendment work, aiming at the enforcement of the amended Labor Union Act in 2022. Vietnam has recently concentrated on the expansion of the conclusion of Free Trade Agreements (FTAs) with foreign countries to secure its economic growth engine and adopted a new Labor Code to reflect the agreed FTA contents (in the labor area) to its laws and improve the contradiction occurring between workplace and labor laws. Especially, in collective labor relations, it allowed multiple organizations of workers (Labor unions and representative groups of laborers) and relaxed regulations on strikes and raised its related legislation to the level of universal labor laws in advanced countries, e.g. Expanding the general and regional binding force of collective agreements. In addition, in individual labor relations, the 6th amended Labor Code improved workers’ working conditions and further protected their rights and interests, achieving the most changes in the history of Vietnam’s labor laws by limiting the increase of overtime, deleting labor contract regulations which have forced labor elements and improving transitional rules on labor relations. South Korea is the country that enters Vietnam most actively and should observe changes in the labor laws closely. Thus, this study examined the new Labor Code and Labor Union Act (Bill) now in the progress of amendment and forecast the impact on labor relations.
