초록
플랫폼은 단지 거래를 중개하는 고유의 의미를 넘어서 새로운 가치를 창출하는 기반을 제공함으로써 미래 산업을 선도할 것으로 예측되고 있다. 그렇지만 플랫폼에 대한 우려도 나타나고 있으며, 특히 플랫폼에서 발생하고 있는 네트워크 효과와 데이터의 집중 현상은 플랫폼의 지배력이 일시적인 것이 아니라 점점 더 강화되고 지속될 것이라는 전망을 낳고 있다. 이러한 상황에서 플랫폼 운영에 있어서 중립적일 것을 규범적으로 요구하는 것에 관한 논의가 일고 있다. 이에 대해 긍정적인 견해는 플랫폼의 지배력이 점점 더 커지고 있고 기존의 법체계가 이를 효과적으로 통제하기 어려운 상황에서 플랫폼에 대한 중립성 요구는 불가피하다는 입장을 취한다. 반면 부정적인 견해에서는 플랫폼이 망중립성에서의 망과는 기본적인 성격을 달리하며, 플랫폼의 지배력이 남용될 경우에 기존의 규제체계로서 충분히 규제가 가능하다고 보고 있다. 플랫폼 중립성의 요구가 플랫폼을 중심으로 한 혁신의 가능성을 지나치게 제한할 수 있다는 점에서 신중한 접근이 필요할 것이다. 그러나 플랫폼에 의해 야기되고 있는 경쟁정책적 우려에 대해서는 지속적으로 주의를 기울일 필요가 있다. 특히 플랫폼의 지대추구적 행태는 플랫폼 참가자들의 경쟁을 제한함으로써 플랫폼의 혁신을 저해하는 효과를 낳을 수 있다는 점을 염두에 두고, 경쟁법에 의한 규제 가능성에 대한 검토가 지속적으로 이루어져야 한다.
Abstract
The platform is expected to lead the future industry by providing a foundation for creating new value beyond the inherent meaning of mediating transactions. But the concerns are rising that the platform, especially its dominance, will have a negative impact. Under these circumstances, there is a debate about the legal requirement to be neutral in platform operations. The positive view is that the platform's demand for neutrality is inevitable at a time when its dominance is growing and the existing legal system is difficult to effectively control it. On the other hand, the negative view believes that the platform is fundamentally different from the network in network neutrality and it is sufficiently regulated as an existing regulatory framework if an operation of the platform is abused. A cautious approach will be needed in that the demand for platform neutrality can excessively limit the possibility of innovation based on the platform. However, continuous attention needs to be paid to competitive policy concerns arising from the platform.
