인류세에서 지구공동체를 위한 지구법학

초록
인류가 자신의 능력으로 지구적 차원의 지질학적 추동력이 되는 인류세 시대에 접어들었다. 인류가 지구의 지질학적 힘이 되면서 나머지 지구공동체 성원과 사이에 형성된 ‘운명공동체’의 지속 가능한 존립을 결정하는 종이 되었다. 인류는 자신과 지구공동체 다른 성원의 생존과 번영을 위하여 지구 시스템에 미치는 자신의 영향력을 적절한 수준과 방식으로 자기 통제해야 하는 책임을 갖게 되었다. 이러한 책임 이행의 맥락에서 법으로써 인간의 행동에 자연의 법(the law of Nature)에 부합하는 규율성을 부과하고자 하는 법철학으로서 ‘지구법학(Earth Jurisprudence)이 태동하였다. 이러한 지구법학은 인간은 더 넓은 존재공동체, 곧 지구공동체의 한 부분이고, 지구공동체의 각 성원의 안녕은 전체로서 지구의 안녕에 의존하고 있다는 사고에 바탕한 법과 거버넌스에 관한 철학으로 정의될 수 있다. 지구법학이 하나의 사상으로서 기존의 환경윤리와 차별성을 갖는 지점은 그것이 ‘지구공동체의 건강과 안녕’을 최고의 ‘공동선’으로 설정하고, 이의 성취를 위한 도구로써 우주의 기능방식을 규율하는 근본 법 내지 원칙(위대한 법)에 부합하는 ‘인간의 법’을 내세우고 있다는 데 있다. 지구법학의 바탕 사상 내지 철학은 신학자이자 문화사학자인 토마스 베리의 사유체계로부터 기원한다. 베리는 인간을 더 큰 지구공동체의 한 부분으로 인정하며, 인간 중심의 법과 거버넌스 시스템에서 지구공동체 중심의 시스템으로의 전환, 곧 지구공동체와 모든 성원의 안녕을 상위의 공동선으로 상정하는 법과 거버넌스의 필요성을 강조하고 있다. 지구공동체의 각 성원의 주체성을 인정하는 전제에서 기본적 권리로 ‘존재할 권리’와 ‘서식지에 대한 권리’ 그리고 ‘지구 공진화과정에서 자신의 기능과 역할을 수행할 권리’가 있음을 주창하며 인간의 법에 이를 반영할 것을 제안하고 있다. 지구법학의 이러한 강조와 제안은 인간 사회는 더 넓은 지구공동체의 일부로 자신을 규율하고, 우주의 작동 방법을 규율하는 근본 법 내지 원칙(위대한 법)에 부합하는 방식으로 행동할 때만 생존 가능하고 또 번영할 수 있다는 관점을 반영하고 있다.
Abstract
The Anthropocene era has entered. What is the responsibility of mankind, who emerged as a global geological force, to the Earth and to the rest of the Earth? What is the responsibility of the world’s systems of law and governance to meet these challenges? Clearly, a “business-as-usual” approach will yield more of the same. A meaningful response to the ecological and social challenges of this era requires a shift of thinking at the jurisprudential level. This Article offers a vision and definition of jurisprudence—an “Earth Jurisprudence”--to guide the transformation of law and governance for the well-being of humanity and the Earth community. EarthJurisprudence is a developing field that rethinks law and governance from an Earth-centered perspective. Earth Jurisprudence is a philosophy of law and human governance based on the idea that humans are only one part of a wider community of beings and that the welfare of each member of that community is dependent on the welfare of the Earth as a whole. From this perspective, human societies will only be viable and flourish if they regulate themselves as part of this wider Earth community and do so in a way that is consistent with the fundamental laws or principles that govern how the Universe functions. We don't understand the rights of the Earth through our understanding of human rights; we understand human rights through our understanding of the rights of the Earth. The time has come for us to change our perspective and think about the law. Earth law will serve as an excellent guide for that.
