지구법학 관점에서 한국헌법의 해석론

The climate crisis caused by global warming is a fundamental change in the question of why the Constitution exists. There is an urgent need to establish a constitutional principle through the interpretation of the constitution as a guideline for legislation even if there is no constitutional amendment. The point of view of the Anthropocene and earth jurisprudence extends the time and space of the constitution, which remains in the modern state (territory), into geological time and earth or universe. The purpose of this article is to develop an earth-jurisprudential interpretation in the Korean Constitution. I have set four themes. The first is human dignity and value. The Anthropocene reinterprets the dignity and values ​​of human beings by questioning the response and responsibility of human beings counting human beings to non-human beings. The second theme is the sustainability of the planet as a prerequisite for safety, freedom and happiness for future generations. The third subject is the issue of extending the issue of national land conservation to the issue of the planet Earth conservation as the basis of human life and the basis of all beings. The fourth issue is to expand the meaning of environmental rights based on the previous three themes Finally, I proposed the prospect of interpreting the Korean Constitution from the perspective of earth jurisprudence by critically examining the judicial precedents of the Korean Constitutional Court.
