바람직한 자치경찰제 시행을 위한「국가경찰과 자치경찰의 조직 및 운영에 관한 법률」의 입법적 보완 방향

This study examined key contents related to municipal police system from「The Act on the Organization and Operation of National Police and Municipal Police」, and sought for the direction for legislative supplementation for enforcement of rational and desirable municipal police system by analyzing various issues through the aforementioned. Analysis results show that First, national police committee has a possibility to hinder independency and democracy of municipal police due to excessive exercise of control authority over municipal police, Legislative supplementation for reestablishment of the role of committee is also considered necessary for national police committee as the committee is lacking in political neutrality. Second, there exist some concerns over damage of democracy and political neutrality in relation to the organization, legal status and authority of municipal police committee of citiesㆍprovinces, so efforts for revising the foregoing are considered necessary. Especially, legislative supplementation of necessary for municipal police committee of citiesㆍprovinces to situate as pivotal organizations of municipal police system by enabling them to exercise more substantial authority while maintaining political neutrality. Third, there exists a possibility of confusion and upset about investigative affairs that are assigned to municipal police in accordance with「The Act on the Organization and Operation of National Police and Municipal Police」, and there is no specific provision of evidence for the scope of governmental financial support and plan for financing, so a plan for financial support still has a long way to go. Therefore, it is necessary to clarify a plan for financing with respect to various finances that the government needs to support such as concrete amount of expenses for various activities of municipal police other than labor costs or operating expenses in addition to readjustment of affairs of municipal police for enabling municipal police to realize decentralization and comprehensive local-friendlyㆍresident-friendly administration service through legislative supplementation.
