프로스포츠 연봉 분쟁의 대체적 분쟁해결(ADR) - 프로야구 주권 선수의 연봉조정 사례(2021년 1월)를 중심으로 -

스포츠 분쟁은 스포츠업계의 변화무쌍한 환경 속에서 대다수 이해관계자들의 복잡다단한 관계가 복잡하게 꼬여서 발생하기 때문에 ‘스포츠산업 분쟁’이라는 단순하고 천편일률적인 틀 안에 포섭하기 때문에 각 분쟁마다 독특한 특성들을 가진다. 그 중에서 프로스포츠의 연봉분쟁은 가장 기술적인 접근이 필요한 분쟁 영역이므로 그 특성을 정확히 파악하고 분쟁 해결의 효율성을 확보할 필요성이 절실하다. 따라서 본 연구에서는 프로야구 KT 주권 선수 사례에 대한 분석을 통하여 연봉조정(salary arbitration)을 포함한 스포츠분쟁 해결방안의 장, 단점 및 개선 방향을 제시함으로써 발생하는 연봉분쟁에 있어 전문성, 신속성, 경제성, 독립성, 자치성, 우호성 등 요소를 충족하는 체제를 구축하고자 한다. 우리나라 프로스포츠산업도 규모가 비약적으로 성장하는 중이며, 각 종목마다 에이전트 제도의 본격적인 도입으로 인하여 전문화, 분업화되는 흐름에 맞춰 프로스포츠의 연봉 분쟁 해결도 발전해 나가야 한다. 프로야구의 경우, KBO에서 운영하는 연봉조정위원회 제도의 현황과 장, 단점을 바탕으로 향후 개선 방향을 고민하고 신속성, 전문성, 공정성을 더 증진시키는 방향으로 진행되어야 할 것이다. 연봉 분쟁이 불가피하다는 점에서 아마추어 스포츠와는 체질적으로 다르다는 점을 고려할 때, 우리 프로스포츠 분야의 분쟁만 전문적으로 다루는 ADR 시스템을 확립할 필요성이 있다. 법원 등 국가 기관의 사전 사후적인 통제를 피하고 프로스포츠 특성을 충분히 반영하면서 ADR이 가진 여러 가지 장점들을 최대한 살려서 프로스포츠 분쟁을 해결해야 한다. 특히, 새로운 분쟁해결유형인 “분쟁 조정ㆍ중재(Med-Arb)”에 주목하여, 조정과 중재의 각 장점을 최대한 조화롭게 융합시켜야 할 것이다.
Abstract
Arbitration is widely used in Kroean professional baseball sports, especailly for the salary dispute. By adjusting to the effects of salary arbitration, teams have developed a valuable tool to keep young talent and to keep salaries reasonable. These players receive a substantial raise over the tendered salaries of their first three seasons. The process of salary arbitration has become an indelible part of baseball. However, what both the players and the owners must consider is the integrity of the game. The current labor woes and work stoppages cannot be fixed with just a passage of an act by congress or a judicial decision. Both the players and owners have to come to an amicable decision where both sides are willing to make sacrifices for the good of the game. If the trend continues, as it has in the past, of players and owners being only concerned with their self-interest, the integrity and popularity of baseball will diminish. Once the fans are fed up with the politics and business of baseball, there will be no turning back for the players and owners. The fans are the ones that bring the money into baseball, whether it is by attendance or purchasing merchandise. If the players and owners continue to quarrel over labor issues and initiate more work stoppages, the fans may be reluctant to follow baseball any more. Therefore, by losing the fans, the economic prosperity that baseball has enjoyed for so long will cease to exist.
