디자인보호법에서의 물품 개념의 재검토

Among the definitions of design in design law, ‘article’ is interpreted as meaning ‘independent, movable, material things.’ According to the above definition, GUI design, building design, and interior design cannot be protected by design law. However, these designs are very important in the modern industry, and most of them are protected as designs in foreign countries. In order to include all of these designs and to include new products that are expected to appear in the future, it is necessary to reconsider the definition of the article. The new definition of an article is appropriate to be ‘a product with a function made by humans, which is traded on the market.’ According to this new definition, font design, GUI design, building and interior designs are all included in the scope of design. Furthermore, new products using holograms in space that leave physical devices, which are expected to emerge more importantly along with the 4th industrial revolution in the future, can be included in the definition of design. In order to include new types of products in the future, the definition of the current design needs a drastic change in a more flexible direction.
