규제수단의 합리적 선택기준 고찰: 개인정보규제를 중심으로

디지털 경제의 핵심자산인 데이터 규제정책은 데이터의 활성화와 개인정보보호를 모두 달성하기 위한 규제수단이 필요하다. 이를 위해 본 연구에서는 데이터규제의 강화 또는 완화 등 이분법적 논의에서 벗어나 데이터의 특성에 따라 적합한 규제수단을 선택하여야 한다는 점에 주목하였다. 이에 우리나라 데이터 규제정책의 중요한 부분을 차지하는 개인정보규제를 중심으로 현재의 규제수단이 적절하게 선택되었는지를 평가하고 규제수단의 관점에서 데이터규제의 개선방안을 제시하는 것을 목적으로 한다. 이를 위해 개인정보관련규제 3건에 대하여 전문가 조사를 실시한 결과 규제내용의 특성을 고려한다면 관리규제가 최적의 규제수단으로 나타났으나, 현행 규제수단은 투입규제에 가까운 것으로 평가되었다. 따라서 향후 데이터 산업 활성화와 개인 프라이버시 보호를 달성하기 위해서는 규제기관이 사전에 준수하여야 할 기준과 행위를 일률적으로 규율하는 투입규제방식에서 벗어나 데이터를 수집·처리·분석하는 피규제기업이 데이터 및 서비스 분야의 특성을 고려하여 적합한 계획을 설계하고 관리시스템을 마련할 수 있도록 자율권을 주는 관리규제수단으로의 전환이 필요하다.
Abstract
The purpose of this research is to present appropriate regulatory policy measures in order to achieve maximum benefits for individuals, businesses and industries through data and information-related activities, but to minimize the risks that may arise from these activities. To achieve the objectives, this research was conducted a expert survey. The expert surveys conducted a assessment of the regulatory condition, and analyzed the appropriateness of regulatory policy measures for each type of data and information. As a result of conducting an expert survey on the content and characteristics of privacy regulations, it was found that management-based regulation is the best regulatory means. However, the current regulatory measure was evaluated as close to the input-based regulation. Therefore In order to revitalize the data industry and achieve personal privacy protection, it is necessary to switch to a management-based regulation.
