북한헌법상 기본권 체계와 관련 법제

초록
북한헌법은 선거권과 피선거권 및 주민소환권의 참정권, 언론⋅출판⋅집회⋅시위와 결사의 자유, 신앙의 자유, 거주⋅여행의 자유, 인신과 주택의 불가침, 서신의 비밀 등 자유권과 평등권, 개인소유권과 상속권, 노동의 권리, 휴식권, 무상치료권, 물질적 방조를 받을 권리, 교육을 받을 권리 등 사회권을 명문으로 보장하고 있다. 그러나 북한은 기본적으로 사회주의 질서를 기반으로 특히 북한식 사회주의를 강조하면서 사상적인 면에서 집단주의로 일원화된 사회의 모습을 보인다. 헌법상의 기본권 체계와 관련 법제도에 이러한 북한 사회의 기본적인 성격이 그대로 반영되어 전체적으로 많은 제한의 가능성을 그 자체에 가지고 있다. 더구나 기본권 침해에 대한 구제수단이 적절하게 마련되어 있지 않아 기본권이 법제적으로 제대로 보장되고 있지 않음을 확인할 수 있다. 다만 헌법이 가지는 법체계 내에서의 최고성의 측면에서 보면 헌법에 명시되어 있는 기본권이 하위 법령의 과정에서 구현해야 할 상위의 원칙으로서 작동하고 있는 점을 부인할 수는 없다.
Abstract
North Korea is a society united by collectivism in terms of ideology, emphasizing North Korean socialism in particular based on the socialist order. This fundamental nature of North Korean society is reflected in the basic rights system of Constitution and related legal system. As a whole, the Constitution itself has many provisions which allow restriction of basic rights. Moreover, it can be confirmed that the basic rights are not properly guaranteed legally because the remedy for infringement of basic rights is not properly prepared in the legal system. However, it cannot be denied that the basic rights stipulated in the Constitution are operating as a higher principle to be embodied in the process of statutes from the viewpoint of the supremacy of the Constitution within the legal system.
