뉴스 애그리게이터는 인터넷 기술 발전에 따라 등장한 새로운 비즈니스 모델이다. 이용자들은 개별 언론사에 들어가 자신이 원하는 뉴스, 기사를 검색하지 않아도 하나의 뉴스 애그리게이터를 통해 모든 정보를 획득할 수 있다는 측면에서 활성화되고 있다. 반면, 개별 언론사 입장에서는 언론사 사이트로의 방문자 감소가 이루어지게 되고, 자연스러운 방문자 감소로 인한 광고 수입과 라이선스 수익 등의 감소로 경제적 어려움을 겪는다. 동시에 뉴스 애그리게이터의 무단 기사 전재 등으로 인해 분쟁이 증가하고 있다. 본 논문은 중국의 대표 뉴스 애그리게이터인 ‘오늘의 헤드라인’과 관련한 최근의 중국 저작권 침해 판결을 소개하고, 중국 법원의 뉴스 애그리게이터에 대한 태도를 살펴보았다. 인터넷과 새로운 기술 발전으로 새로운 유형의 저작권 분쟁이 발생하고, 국내에서도 뉴스 애그리게이터와 같은 신산업 분야들이 등장함에 따라 중국과 마찬가지의 저작권 분쟁에 노출되어있다는 점에서 본 사건에 관한 연구는 향후 관련 문제 연구에 참고가 될 수 있을 것이다.
Abstract
News aggregators are a new business model that emerged as Internet technology advances. It is active in terms of being able to get all the information through a single news aggregator without having to enter individual media companies and search for news and articles they want. On the other hand, for individual media companies, the number of visitors to the media site naturally decreased, which caused economic difficulties due to the decrease in the media's income and licensing revenue. In addition, disputes are increasing due to unauthorized change of the title of the news aggregator. This paper introduced the latest Chinese copyright infringement judgment regarding China's leading news aggregator, ‘Toutiao’, and examined the Chinese court's attitude toward news aggregators. The development of the Internet and new technologies may create new types of copyright disputes, and the emergence of new industries such as news aggregators in Korea could lead to similar copyright disputes with China. Research on this case may be a reference to future research on relevant issues.
