기업 특허의 무효심판에서 상소 여부에 영향을 미치는 요인에 대한 계량경제 분석

2001년~2017년 기간에 제기된 무효심판 사건 중 특허권자가 기업인 3,229건의 사건 자료를 대상으로 특허심판원의 무효심판 심결 후 상소의 지속 여부에 영향을 미치는 요인에 대하여 분석하였다. 특허심판원에 무효심판이 청구된사건들 중 특허심판원에서 종결 또는 특허법원으로 항소되는 1단계 이행과정과 특허법원에 항소된 사건들 중 특허법원에서 종결 또는 대법원으로 상고되는 2단계 이행과정에 영향을 미치는 요인을 분석하기 위하여 순차적 이행과정을 유연하게 반영할 수 있는 순차로짓모형을 분석모형으로 채택하였다. 특허 특성, 사건 특성, 기업 특성을 고려한 실증분석결과에 따르면, 특허심판원에서 특허법원으로의 항소에 미치는 요인과 특허법원에서 대법원으로의 상고에 영향을 미치는 요인 간에 차이가 있는 것으로 나타났다. 특허심판원에서 특허법원으로 항소하는 단계에서는 특허의 특성이 유의하게 영향을 미치는 반면 특허법원에서 대법원으로 상고하는 단계에서는 기업의 규모 또는 분쟁상대방의 유형이 유의하게 영향을 미치는 것으로 나타났다. 특히, 특허의 전략적 가치 중 특허권자의 경쟁 우위를 대변하는 특허 특성이 상소의지속 여부에 중요한 요인으로 작용하는 것으로 나타났다.
Abstract
We analyze factors affecting the sequential progression and conclusion of patent invalidation trials in Korea when patentees are firms, using the data set of 3,229 cases involved in invalidation litigation between 2001 and 2017. We specify a sequential logit model to accommodate the sequential nature of the litigation process. We find that there are differences in factors affecting the progression of trials from the Patent Tribunal to the Patent Court and those from the Patent Court to the Supreme Court. Characteristics of the patent play an important role in the progression from the Patent Tribunal to the Patent Court, whereas patentee’s size and the type of the counterparty play an important role in the progression from the Patent Court to the Supreme Court. Explanatory variables reflecting patentee’s competitiveness in the area of patent’s technology, which represents an aspect of patent’s strategic value, are found to have statistically significant and positive impacts on the sequential progress, thereby reducing the chances of an early settlement.
