연구자 이직과 연구보안의 쟁점에 관한 연구: 연구보안 실무상 문제가 되는 사례분석과 해결점을 중심으로

최근 연구기관에서 연구자 이동성이 증가하여 연구자가 이직 또는 퇴직하는 경우가 빈번하게 발생하여 연구자가 소속되었던 원 재직기관에서는 연구보안의 관점에서 기관의 핵심적인 기술이 유출될 가능성이 증가 하였다. 따라서, 명확하게 연구자의 이직 혹은 퇴직 시 권리관계를 규정하지 않는다면, 연구자를 새로 고용하여 연구를 수행하는 기관에서도의도하지 않게 이직하기 이전의 연구기관과 불필요한 지식재산권 분쟁에 휘말릴 수 있게 되었다. 본 논문은 연구자가 연구기관을 이직하여 연구를 수행하는 경우 연구자는 물론, 원 소속기관과 이직한 연구자가 소속된 기관간의 지식재산권리 관계 정리를 통한 해결책을 찾고자 한다. 기존 이론적인 연구와 달리 실증적인 사례분석을통하여 연구자 재직 중 대형기술이전을 하고 이직하는 사례, 동일 유사한 분야 연구를 수행하던 연구자 그룹에서 다른연구자가 일방적으로 연구 성과물 등을 독점하여 회사를 창업하고 다른 기관으로 이직하는 사례 등을 통하여 연구자 이직과 보안쟁점에 관한 내용을 살펴보고 분석함으로써 향후 연구기관과 연구보안 실무자 등이 연구자 이직 및 퇴직 시주의할 점에 대한 시사점을 제공 하고자 한다.
Abstract
In recent years, as the turn over rate of researchers in research institutes has increase, retirement has frequently occur, so the possibility of technology leakage in terms of research security for the intellectual property of the currently employed institution has the risk escalated. Researchers can select research institutes for convergence or cooperative research. Therefore, the security issues such as intellectual property rights and trade secrets, which occurred in the institution where the researcher is currently employed, should be cleared up of these rights relations when moving to a new institution. While the previous studies have dealt with contracts and compensation of job transfer, this paper analyzes the practical issues of the infringement and research security of intellectual property rights. When a researcher relocates to an institution and conducts research, the researcher, wants to find a solution by reorganization of rights and customs of the researcher's organization before and after the move. The cases raise the alarms to the security issues in the research institutions.
