초록
2020년에 선고된 우리나라 중요해상판결 7개를 평석하였는데, 그 요약은 아래와 같다. 대법원 2019. 11. 14. 선고 2017다224807 판결에서는 항해용선계약상 준거법인 영국법에 따라 당사자의 의사를 해석하여 선복확약서 중 용선자로 서명한 자를 계약당사자로 해석하였다. 대법원 2019. 12. 27. 선고 2019다218486 판결에서는 정기용선계약의 부속서상 잔존연료유 정산 규정이 정기용선계약의 중도해지에는 적용되지 않는 것으로 해석되며, 준거법인 영국법상 정기용선자가 연료유대금을 지급하지 못한 경우에는 잔존연료유에 대한 소유권이 인정되지 않으므로, 정기용선자는 선주들에 대하여 잔존연료유 대금채권을 자동채권으로 한 상계를 할 수 없다고 보았다. 대법원 2020. 1. 16. 선고 2019두54092 판결 및 그 하급심 판결인 대전고등법원 2019. 9. 18. 선고 2019누10342 판결에서는 어떤 수로가 좁은 수로에 해당하는지 여부는, 해당 수로의 지리적 조건, 통항 선박, 자연적 조건 등을 감안하여 결정하여야 하고, 어떤 수로가 좁은 수로로 판단된다면, “사고 선박의 크기”나 “항행 방향”과 무관하게 좁은 수로에서의 항법이 적용되어야 한다고 판단하였다. 대법원 2020. 2. 27. 선고 2017두37215 판결에서는 해양수산부 고시인 ‘무역항의 항만시설 사용 및 사용료에 관한 규정’의 화물입출항료 징수대상시설 중 수역시설에 관한 부분이 위임입법의 한계를 벗어나지 않았다고 판시하였다. 대법원 2020. 6. 4. 선고 2020다204049 판결에서는 영국 해상보험법 제39조 제5항에 따라 예인선의 선주가 부적절한 예인방식을 취함으로써 발생한 손해에 대하여 보험자들의 면책을 인정하였다. 대법원 2020. 6. 11. 선고 2018다249018 판결에서는 운송인이 아닌 자가 발행한 스위치 선하증권이 적법한 선하증권이 아니라서 유가증권으로서 효력이 없으며, 발행인은 이를 선의로 취득한 자에 대하여도 책임을 부담하지 않는다고 판시하였다. 대법원 2020. 7. 9. 선고 2017다56455 판결에서는 선박소유자가 수심 약 90미터에 침몰하여 방치되어 있는 선박에 대하여 자신에게 내려진 제거 및 구난명령과 관련하여, 선체인양비용 상당의 손해가 현실적․확정적으로 발생하였다고 볼 수 없다고 보아 가해선박 선주의 선체인양비용 상당의 손해배상책임을 부정하였다.
Abstract
In 2020, the Korean Supreme Court (hereinafter “KSC”) rendered 7 decisions involving important maritime law issues. Summaries of the court decisions are as follows： (1) In the KSC case 2019. 11. 14. Docket No. 2017da224807, the KSC held that the charterer was a party who signed its name in the fixture note on the basis of the English law, which was the governing law of voyage charterparty. (2) In the KSC case 2019. 12. 27. Docket No. 2019da218486, the KSC denied the time charterer’s right to set-off claiming the price of the remaining bunker in the vessel against the shipowner after the redelivery of such vessel because an additional clause regarding the remaining bunker cannot be applied to the termination of the time charter during the charter period and the time charterer cannot obtain the ownership of bunker without payment for such bunker. (3) In the KSC 2020. 1. 16. Docket No. 2019da54092, the KSC held that whether a sea passage is a narrow sea passage shall be determined by the geographical conditions of the passage in question, the type and size of the vessel in question, the volume of sea traffic and the natural conditions of the passage, etc. When a sea passage is considered as the narrow one, the navigational method for the narrow sea passage must be applied regardless of the size or direction of the vessel. (4) In the KSC 2020. 2. 27. Docket No. 2017da37215, the KSC ruled that the relevant part of water facilities in the Notification of the Ministry of Maritime Affairs and Fisheries imposing fee for cargo arrival and departure at a trade port in Korea does not violate the range of delegation recognized by the Act on Port Authorities. (5) In the KSC 2020. 6. 4. Docket No. 2020da204049, the KSC rejected the claim made by a shipowner of a tug (an assured of hull insurance) against insurers based on the article 39(5) of UK Marine Insurance Act, 1906, by reason of adopting improper tow methods for carriage. (6) In the KSC 2020. 6. 11. Docket No. 2018da249018, the KSC held that a switch bill of lading issued by a party other than a carrier of the cargo is null and void, and the issuer shall not be liable for the loss of or damage to the cargo against a bona fide holder of such bill of lading. (7) In the KSC 2020. 7. 9. Docket No. 2017da56455, the KSC held that a shipowner of a vessel, who is responsible for a collision accident, is not liable for ship salvage costs against a shipowner of a vessel, which sank to the bottom of the sea, approximately 90 meters below the surface, because the loss of the shipowner of the sunken vessel is not realized and established considering the possibility of refloating such vessel.
