파리기후변화협약체제와 온실가스 감축목표의 이행

이 논문은 파리협정의 문언과 파리이행규칙의 세부내용을 검토하여 파리기후변화협약체제의 주요내용을 정확하게 파악하고 그 성공 여부를 잠정적으로 예측・평가하기 위한 목적을 가지고 있으며, 파리이행규칙에 포함되지 못한 파리협정 제6조의 시장메카니즘에 관한 주요쟁점에 대해서도 살펴 본다. UNFCCC, 파리협정, 파리이행규칙으로 구성되는 파리기후변화협약체제의 주요골자는 야심찬 목표와 야심주기, 상향식 접근, 투명성체계를 중심으로 하는 절차규범, 차별화로 요약정리될 수 있다. 특히 상향식 접근, 절차규범, 차별화는 선진국에게만 온실가스 배출량의 감축의무를 부과했던 교토의정서체제의 한계를 극복할 수 있었던 주된 성공요인이었다. 파리협정을 순수한 절차규범으로 설계하여 당사국에게 법적 구속력을 갖는 감축의무를 부과하지 않는 대신 NDC의 수립・제출 및 관련 정보의 제공을 통한 투명성과 책임성의 강화를 핵심적인 이행수단으로 삼고 있는 것이 신체제의 가장 큰 특징이다. 그 요체는 투명성체계를 근간으로 하여 전지구적 이행점검과 NDC의 수립・제출의 반복적인 시행을 통한 야심주기 또는 강화메카니즘의 생성이다. 이 점에서 파리이행규칙에서 구체화된 절차적 요건의 효과성이 파리기후변화협약체제의 성패를 좌우하는 핵심요소이다. 파리이행규칙은 NDC의 명확성・투명성・이해가능성(CTU)을 제고하기 위해 투명성체계의 세부사항을 정하고 있다. 감축목표 및 온실가스 인벤토리의 산정에 있어서 IPCC의 관련 지침에 따른 방법론의 표준화와 그 적용의 일관성을 강조하고, 관련 정보의 구체성과 포괄성을 강하게 요구하고 있다. 전문가심사, 촉진적이고 다자적인 검토, 전지구적 이행점검, 이행 및 준수 메카니즘의 세부절차도 각각 마련하고 있다. 종합해서 보면 이러한 점들은 엄청난 가시적인 성과로 평가하는 것에 대해 이론의 여지가 없으며 기후변화문제의 해결을 향한 진보의 제도적 기반이 될 것이다. 하지만 일정한 한계도 존재한다. 첫째, 명확성・투명성・이해가능성(CTU)에 관한 절차적 요건은 제2차 NDC의 제출 시부터 적용된다. 둘째, 감축목표, 이행기간, 적용대상 산업부문과 온실가스의 범위, 배출원과 흡수원의 산정을 위한 방법론과 측정단위 등 NDC의 특징과 관련 정보의 표준화가 이루어지지 못함으로써 각국이 제출한 NDC의 비교평가를 어렵게 하고 있다. 셋째, CBDR-RC를 구현하기 위한 것이긴 하지만, 후진국에 대해서 다양한 예외를 인정하고 있고, 예외의 적용 여부는 전적으로 해당 국가의 판단에 위임되어 있다. 넷째, NDC의 성과를 평가하는데 있어 핵심이 되는 정보가 표준화되어 있지 못한데다 구체적이고 포괄적인 관련 정보의 제공을 요구하고 있어 각국의 NDC, 온실가스 인벤토리 보고서와 투명성보고서를 분석하고 이해하는데 상당한 시간과 노력이 소요될 것으로 보이며, 경제수준이 낮은 후진국들에게 과중한 부담이 될 것으로 보인다. 다섯째, 전문가심사와 이행 및 준수 메카니즘의 심사범위는 순수한 절차위반으로 한정되어 있고, 감축목표나 이행조치의 적절성에 대한 판단은 금지되어 있으며, 어떠한 형태의 제재나 비난도 허용되지 않는다. 여섯째, 시장메카니즘의 세부사항에 대한 합의실패는 국제배출권거래시장의 확대를 가로막는 요인이 되고 있다. 파리이행규칙이 제정되기 위해서는 이중계산의 방지를 위한 상응조정을 비롯한 환경적 건전성의 확보방안과 거버넌스의 문제가 해결되어야 한다. 기본적으로 파리이행규칙은 파리협정의 문언에 충실하게 설계되어 있다고 보아야 하므로, 이러한 한계들은 대부분 파리이행규칙의 문제가 아니라 수권규범인 파리협정의 패러다임에 기인한다. 상향식 접근에 기초한 순수한 절차규범이라는 파리협정의 패러다임이 양날의 검으로 작용하여 파리협정의 이상인 야심찬 목표의 실현과 현실 간에는 쉽게 좁힐 수 없는 격차가 존재한다. 새로운 패러다임이 성공하기 위해서는 파리이행규칙의 완성과 함께 감축목표의 이행을 실질적으로 강제하는 책임성의 요소를 강화하는 방향으로 나가야 한다. NDC와 정보의 표준화는 필수적이며, 단기적으로는 전문가심사와 이행 및 준수 메카니즘의 심사범위를 확대하는 방안이 가장 현실적인 대안이다.
Abstract
The purpose of this Article is to discuss the essential elements of the Paris Agreement and its implementing Paris Rulebook, which in fact repealed the ill-fated Kyoto Protocol to the United Nations Framework Convention on Climate Change, and to predict the possibility of the Agreement’s success. It also examines controversial design issues concerning the market-based mechanisms under the Paris Agreement that consist of cooperative approaches and sustainable development mechanisms. The characteristics of the Paris Agreement can be summarized as follows: (i) ambitious goals and the ambitious cycle; (ii) a bottom-up approach, which allows individual countries voluntarily to set abatement goals and establish implementation plans, called nationally determined contributions (NDCs); (iii) its process-based character, which means that the Agreement does not imposed upon parties a legal duty to reduce greenhouse gases, while the transparency framework is primarily designed to guarantee its effectiveness, promoting comparability and accountability with detailed information about NDCs and greenhouse gas inventories that parties are obliged to provide periodically; and (v) its differentitation between developed and developing countries on a case-by-case basis, not categorically. Therefore, its success depends in large part upon the effectiveness of the transparency framework whose details are to be finalized by the Paris Rulebook. The Paris Rulebook reinforces the strengths of the transparency framework by making detailed rules on clarity, transparency and understanding of NDCs and biennial national reports on greenhouse gas inventories. It aims to standardize NDCs and related information, and requires in fact the adoption of IPCC guidelines on methodologies and common metrics in calculating emissions and sinks. Overall, the Paris Rulebook is a great achievement in that it provides institutional bases. The Paris Rulebook has its limits, however. Its failure to standardize NDC features, implementation periods, scope and coverage, and the like weakens the effectiveness of the transparency framework. Moreover, the scope of technical expert review and the compliance and implementation mechanism is limited only to violations of procedural obligations. These weaknesses originate in the above-mentioned Agreement’s paradigm: its process-based, bottom-up approach. Finally, parties to the Paris Agreement have yet to agree upon guiding principles and accounting rules with regard to market-based mechanisms. To succeed, the new Paris climate change regime needs to strengthen the transparency framework with increasing the level of accountability.
