해외 주요 국가의 공직자 이해충돌방지법 규정과 관리 기관 제도 분석

공직자 이해충돌방지법･제도는 어떻게 운영되어야 할까? 본 연구는 해외 주요 국가들을 대상으로 공직자 이해충돌방지법 규정과 관리 방안에 대해 분석하였다. 구체적으로 본 연구에서는 UN(2020)과 OECD(2003) 기준에 따라 국제투명성기구에서 발표한 2020년 부패인식지수 상위권에 속하는 9개 국가들의 이해충돌방지법 규정과 관리 기관에 대해 분석하였다. 그 결과 부패인식지수 상위권 국가들은 공통적으로 공직자의 재산신고 및 공개의무 등 공직자 이해충돌방지 관리 방안을 적극적으로 실행하고 있었고, 각 국가의 특징에 맞게 공직자 이해충돌방지 관리 기관을 설치･운영하고 있었으며, 공직자들이 이해충돌방지법 규정을 위반하였을 시 행정 및 형사처벌을 하는 등의 강력한 제재 규정을 두고 있었다. 또한 공직 내 윤리교육, 윤리프로그램, 카운슬링 등을 실행하여 공직자들의 이해충돌에 대한 인식개선을 위해 노력하고 있었다. 효과적인 이해충돌방지 관리 방안은 각 국가의 정치체제 및 문화, 역사적 전통, 공직에 대한 인식 등에 따라 달라질 수 있을 것이다. 하지만 본 연구에서 시행한 이해충돌방지법･제도에 대한 해외 사례 연구는 공직자 이해충돌방지 관리 방안의 실효성이 낮은 한국의 공직사회에 중요한 함의를 제시해 줄 수 있을 것이다.
Abstract
How should the laws and systems to prevent conflicts of interest for public officials be operated? Our study analyzed the regulations and management measures for conflicts of interest of public officials targeting major foreign countries. In particular, according to the standards of the UN(2020) and the OECD(2003), we analyzed the conflict of interest laws and management agencies of nine countries that are among the top ranking countries in the 2020 Corruption Perceptions Index(CPI) published by Transparency International. As a result, we found that countries with the highest CPI are actively implementing measures to manage conflicts of interest for public officials, such as public officials' property reporting and disclosure obligations, and have established and operated public officials conflict of interest management institutions according to the characteristics of each country. In addition, in the event of violation of the conflict of interest regulations, there were strong sanctions regulations such as administrative and criminal penalties. Moreover, countries with the highest CPI have implemented ethics education, ethics programs, and counseling in public offices to improve public officials' awareness of conflicts of interest. Effective conflict of interest management measures might vary depending on each country's political system and culture, historical traditions, and perceptions of public office. However, our case study on the conflict of interest laws and systems could provide important implications for the Korean public officials society, where the effectiveness of the management plan for public officials conflict of interest is low.
