청소년안전사고 판례를 통해 본 청소년지도자의 법적 책임

The purpose of this study is to investigate the legal criteria required to protect youth workers from the shifting of responsibility for accidents and human rights abuse in safety accidents, and to provide appropriate knowledge of safety consciousness. It further sought to carry out analysis of legal or situational precedents in order to devise a scope of liability and standards of judgement for youth workers. Our main research findings were as follows. Legal criteria applied to youth workers in the case of safety accidents in youth work is associated with the results of safety accidents, causation between negligence and fault by youth workers, predictability of accidents, consideration of safety obligations, and the obligations of supervisors. In addition, we examined how different relevant laws have been applied depending on the type of youth activities with special duties of care. Thus, this study shows that major standards of judgement in youth workers’ legal liability is required in legal disputes in the case of youth safety accidents, supervisory responsibility of employers and organizational leaders, It also reveals how professional teaching ability of safety instructors and recognition of safety training needs to be improved and also reveals the necessity of continuous study regarding legal protection. Relevant organizations clearly need to develop detailed safety manuals suitable for youth activities, expand opportunities to educate, and to protect young workers from the shifting of responsibility for unsafe, unfair work practices and human right abuses as well.
