주택임대차보호법상 갱신요구권 제도의 개선 방안 - 캐나다 온타리오주 법제의 시사점 -

초록
캐나다 온타리오주는 인구 밀집도가 높고 새로운 유입 인구가 많아 주택 임대차 안정화 정책의 필요성이 큰 토론토 등 대도시가 밀집되어 있는 주로서, 주택임대차에 갱신요구권을 도입하여 시행 초반에 있는 우리에게 많은 시사점을 준다. 온타리오주 임대차 법제는 주택임차법과 임대차위원회를 통하여 임차인 보호와 임대인의 절차적 권리 보장을 실현하고 있다. 온타리오주 법제에서 보여지는 시사점을 통해 우리가 임대차 안정화 방안의 하나로 주택임대차보호법에 도입한 갱신요구권에 관하여 점차 보완하여야 할 방향에 대하여 생각해보면 다음과 같다. ① 갱신요구 방식에서 갱신거절 방식으로 전환, ② 갱신 횟수 및 갱신 기간의 확대, ③ 갱신거절 사유의 보완, ④ 갱신 시 차임의 증감 기준과 임차인의 지위 보장, ⑤ 법정 손해배상 제도의 보완, 그리고 ⑥ 신속하고 경제적인 분쟁해결 절차의 마련 등이다. 이와 더불어 임대인과 임차인 간의 분쟁을 신속하고 경제적으로 해결할 수 있는 절차로서, 주택임대차조정위원회의 기능을 대폭 보강하여 조정전치주의로의 전환 및 조정에 대한 집행력을 부여하여 효율적인 해결에 이르도록 제도를 마련하는 것도 필요하다.
Abstract
Ontario has many implications for introducing new renewal claims for housing leases, given that housing stabilization is well realized under the Residential Tenancies Act, 2006 and the Landlord and Tenant Board, despite its high population. Referring to Ontario legislation, we consider the following points to be complemented and revised in order to stabilize the lease in the process of implementing the renewal requirement. They include switching from renewal request to renewal rejection, supplementation of reasons for renewal, expansion of renewal frequency and renewal period, increase or decrease standards of demurrage and guarantee of tenant status, supplementation of statutory damages, and rapid and economic dispute settlement procedures. In addition, as a quick and economical way to resolve disputes over renewal and eviction between renters and tenants, it is necessary to significantly reinforce the function of the Housing Lease Dispute Consolidation Committee to provide enforcement for coordination.
