초록
최근 테러 등의 범죄뿐만 아니라 가족 및 연인 간의 범죄 행위로부터 국민의 안녕을 보호하고자 경찰권이 선제적으로 개입해야 한다는 주장 및 필요성이 제기되고 있고 이러한 요청을 반사적으로 경찰권의 확대가 초래될 우려가 있다. 위험 개념의 확장 및 예방국가의 등장 등이 그 배경으로 대두되고 있는데, 탈경찰화를 거친 후에도 실효적인 위험방어의 시스템을 구축하고 있는 독일의 경찰법 질서를 참조하고, 역시 탈경찰화를 거쳤지만 독일과는 다른 법제를 취하고 있는 일본의 경우는 어떠한지를 비교법적으로 검토한 뒤 탈경찰화와 위험임무의 배분 원리인 보충성 원리가 가지는 법적인 의미가 무엇인지를 살펴본다. 위의 연구결과를 토대로 우리나라의 경찰관련입법을 조사하여 일반행정기관, 사법기관, 민간기관과의 관계에서 경찰기관의 임무배분의 규정 및 그 원리를 공통적으로 추출하여 독일과 일본의 경우와 그 임무배분에 있어 차이점이 무엇인지를 밝히고자 한다. 그 과정을 통해 경찰기관의 적정한 임무가 무엇인지 그 특징을 밝히고, 질서유지의 효율성 향상과 경찰권력의 통제라는 시점에서 구체적으로 실정법 위주의 검토를 행한다. 종국적으로 경찰기관과 기타 기관과의 적합한 임무배분 원리 하에 협력의 가능성과 한계 등을 규명함으로써 공백없는 위험 방어 즉 실효성 있는 위험 방어를 도모하고자 한다.
Abstract
Recently, there have been calls and needs for police rights to preemptively intervene to protect the safety of the people from family and lovers as well as crimes such as terrorism, and there are concerns that such requests will lead to the expansion of police rights. The expansion of the concept of risk and the emergence of a preventive state are the background, referring to the German police law order, which establishes an effective risk defense system after de-policeization. Based on the results of the above research, we will investigate the police-related legislation in Korea and extract the rules and principles of the allocation of duties from general administrative agencies, law enforcement agencies, and private institutions. Through the process, it identifies the proper duties of police agencies, and conducts a specific law-oriented review in terms of improving order efficiency and controlling police power. Ultimately, the government intends to identify the possibility and limitations of cooperation under the principle of appropriate assignment of duties with police agencies and other agencies to promote effective risk defense.
