재난관리 관점에서 본 유해화학물질 유출사고 예방기능 강화의 필요성과 법적 과제 - 화학물질관리법제의 개선방안을 중심으로 -

오늘날 우리사회가 직면하는 재난의 규모는 점차 대형화되어 가고 있으며, 재난의 진행양상도 복잡해지는 특징을 보이고 있다. 재난을 관리하기 위한 법제도는 재난이 발생하고 난 이후 지속적으로 정비되고 개선되면서 발전하고 있다는 점에서 재난이 발생되기 이전과 이후에 드러난 문제점을 분석하고, 이를 해결하기 위한 법제적 연구가 반드시 필요하다. 재난관리에 있어 모법이라고 할 수 있는 「재난 및 안전관리 기본법」에 따라 재난의 예방·대비·대응·복구를 위한 모든 활동을 재난관리라고 정의하고 있으며, 재난의 유형은 크게 자연재난과 사회재난으로 구분하여 관리되고 있다. 특히 오늘날 재난관리 측면에서 바라보면, 풍수해 등으로 인한 이른바 전통적 재난과는 달리 사회재난의 유형은 날로 다양해지고 있고 이를 관리하기 위한 법령도 점차 강화되고 있다. 이와 같은 측면에서 본고에서는 사회재난의 한 유형인 유해화학물질 유출사고를 예방하기 위한 법적 근거를 분석하기 위해 「화학물질관리법」을 중심으로 하여 재난예방을 목적으로 두고 있는 규정을 살펴보고자 한다. 유해화학물질 유출사고로는 처음으로 특별재난지역이 선포된 바 있는 2012년 구미 휴브글로벌 불산누출 사고로 인해 23명의 인명피해가 발생되었으며, 이는 우리 사회에 화학물질의 위험성과 그 관리의 중요성을 일깨우게 하는 큰 사건 중 하나였다. 이후 「유해화학물질관리법」이 「화학물질관리법」으로 전면개정 되면서, 화학물질로 인한 사고와 재난을 예방하기 위한 법적 근거는 다소 보완되었다고 할 수 있다. 그러나 점차 화학사고에 관한 안전규제 조치가 완화되면서 화학물질로 인한 재해가 다시 빈번히 발생되고 있다는 사실을 통해 「화학물질관리법」에서의 보다 강화되고 실효성 있는 법적 개선방안을 제시함으로써 향후 유해화학물질 사고를 예방하기 위한 입법정책을 모색하는데 기여하고자 한다.
Abstract
The scale of disasters facing our society today is gradually becoming larger, and the progression of disasters is characterized by being complicated. Since the legal system for managing disasters is continuously improved and improved after a disaster, it is necessary to analyze the problems that have been revealed before and after the disaster, and legal research to resolve them. According to the framework act on the management of disasters and safety, all activities for disaster prevention-preparation-response-recovery are defined as disaster management, and the types of disasters are largely divided into natural and social disasters and managed. In particular, from the perspective of disaster management, unlike traditional disasters caused by storms and floods, the types of social disasters are gradually diversifying, and legislations to manage them are also being strengthened. In this respect, this study aims to examine the regulations on disaster prevention, focusing on the chemical substance management act in order to analyze the legal basis for preventing the leakage of hazardous chemical substances, which is a type of social disaster. In 2012, when a special disaster area was declared for the first time as a hazardous chemical leakage accident from the Hube Global plant in Gumi caused 23 casualties, reminding our society of the dangers of chemical substances and the importance of their management. It was one of the major social disasters. Later, as the toxic chemical substances control act was completely revised to the chemical substance management act, the legal basis for preventing accidents and disasters caused by chemical substances was somewhat supplemented. However, with the fact that accidents caused by chemical substances are frequently occurring again as safety regulatory measures for chemical accidents are gradually eased, more strengthened and effective legal improvement measures in the chemical substance control act are proposed to prevent future hazardous chemical accidents. It intends to contribute to the search for a legislative policy to prevent it.
