초록
인공지능은 인권에 어떠한 도전이 될 것인가? 이미 인공지능이 인권을 침해하고 위협하는 부분이 있다. 혐오표현 등을 규율하기 위한 인공지능 활용은의도하지 않게 표현의 자유의 문제를 발생시킬 수 있다. 인공지능이 부적절하다고 판단한 표현을 자동 제거할 때, 소수의 견해 등이 같이 배제될 위험이있기 때문이다. 그러나 인공지능에게 혐오표현 등을 규율하게 맡기는 것은 장기적으로 보았을 때 더 심각한 문제를 내포한다. 기술적으로 보았을 때, 인공지능이 몇 개의 주제어를 제거하는 것에 그치는 것이 아니라 인공지능이 스스로 판단해야 할 사안들이 발생할 수 있기 때문이다. 이 과정에서 인공지능이 스스로 차별을 자행할 수도 있다. 기존 데이터로 스스로 학습한 인공지능이 누적된 편견을 그대로 반영할 수 있기 때문이다. 또, 수많은 정보를 수집하여 판단하는 과정 속에서 프라이버시의 문제를 발생시킬 수도 있다. 이러한문제는 거시적으로 보았을 때 인공지능에 의한 감시 사회가 현실화 될 수 있는 가능성을 암시한다. 인공지능과 관련하여 이런 문제들은 이미 현실로 일어났거나 일어날 가능성이 높은 사안들이다. 본 연구는 바로 이러한 일상에서발생하는 인권 사안에 초점을 맞추고자 한다. 이러한 사안들은 최근 인공지능에 대한 국제법 논의에서 상대적으로 적게 연구된 듯하다. 본 연구는 관련된문제에 모든 답을 제시하는 것을 목적으로 하지 않는다. 이 보다 문제 제기차원에서 그 의의가 있다고 할 수 있다. 의식하지도 못한 상황에서 그 사회구성원의 자유가 줄어들고 있을 수 있다. 인공지능이 활용되는 사회에서는 어떻게 해야 더 자유로운 인간이 될 수 있을지 더 깊이 있게 고찰해 보아야 한다.
Abstract
How will artificial intelligence (AI) be a challenge to human rights? There is already a part that threatens human rights by the utilization of AI. The use of AI to regulate hate speech, but such action can unintentionally create a problem of freedom of expression. This is because when artificial intelligence automatically removes expressions that are deemed inappropriate, there is a risk that minor opinions will be excluded at the same time. However, leaving AI to discipline hate speech poses a more serious problem in the long run. Technically, this is because AI does not merely remove a few key words, but there are issues that AI has to judge for itself. In this process, AI may cause discrimination. This is because AI that has learned by itself with existing data can reflect the accumulated bias. In addition, in the process of collecting and determining mass information, it may cause privacy problems. From a macroscopic perspective, this problem can be an issue that can make a society of surveillance by AI a reality. When it comes to AI, these questions have already arisen or are highly probable. This study aims to focus on human rights issues that arise in these daily lives. These issues seem to have been studied relatively little in recent international law studies on artificial intelligence. Therefore, the purpose of this study is to examine the challenges of human rights today with the advent of AI. In particular, we will review the issues of human rights violations that have already occurred. This study is not intended to provide all answers to related problems. It is more focused on raising the issue. The freedom of the members of the society may be diminishing while they are not even conscious of. In a society where AI is utilized, there is a point to consider in more depth about how to become a freer human being.
