합리적인 빅데이터 기반의 스마트시티 구현을 위한 법적 고찰

초록
본 연구는 합리적인 스마트시티 정립을 위해 법리적으로 고찰하여 개선방향을 제시하는 것이 주된 목표이다. 오늘날의 현실을 감안하고 향후 우리가 나아가야 할 길을 찾는 과정이라고 할 수 있다. 즉 누구도 부정할 수 없을 정도로 지금은 인터넷을 빼고 얘기하는 것이 불가능할 정도로 우리 생활 깊숙이 스며들었고, 정치･경제･사회･문화･교육･치안･금융 등 이루다 열거할 수 없을 만큼 필수 불가결한 요소가 되었다. 그리고 모든 영역은 공통적으로 정형 및 비정형 정보의 집적체인 빅데이터를 매개로 하게 된다. 이를 통해 인류는 문명의 혜택을 누리고 있는 가운데 그 변화의 속도는 점점 더 빨라지고 있고, 활용 영역은 더욱 다양해지고 있는 것이 사실이다. 이렇듯 다양한 영역 중에서 합리적인 스마트시티의 구축을 위해 스마트시티에 대한 전반적인 개관을 시작으로 우리에게 시사하는 바가 큰 해외 주요국들의 논의배경과 구체적인 추진분야를 검토했다. 그리고 본 연구의 핵심으로써 전반적인 법･제도 개선방향을 제안하고, 제21대 국회에 계류 중인 스마트시티 관련 법안을 분석했다. 또한 스마트시티에서의 빅데이터 관리 가이드라인을 마련하기 위해 ITU-T 프레임워크에 대해서 소개하고 우리가 반영할 수 있는 부분을 강조하여 정리했다. 그러나 무엇보다 더 중요한 것은 과연 어떻게 하면 부정적인 측면을 최소화하고 생활의 편익 등 긍정적인 효과를 극대화한 스마트시티를 구현할 것인가에 대한 실질적인 논의를 이어가는 것이라고 본다.
Abstract
The main goal of this study is to consider legally and suggest improvement directions for the establishment of a reasonable smart city. It can be said that it is the process of understanding today and finding the path we should take in the future. In other words, the Internet has become such an essential element now that no one can deny it, and all areas are commonly used as mediators of big data. While humanity enjoys the benefits of civilization, the pace of change is getting faster and faster, and the areas of application are becoming more diverse. In order to establish a smart city among various areas, we review the background of discussions in major foreign countries, which has a great meaning for us, starting with the general overview. In addition, as the core of this study, it proposes the directions for improvement of laws and systems, and analyzes the smart city-related bills being discussed in the National Assembly. In addition, in order to prepare the guidelines for big data management in smart cities, the ITU-T framework is introduced and what we can reflect is emphasized. However, I think the most important thing is to constantly discuss practically how to implement a smart city that minimizes negative aspects and maximizes positive effects.
