비종사 조합원의 사업장 내 노조활동에 관한 고찰

노조법 개정을 통해 해고자 등 비종사자의 기업별 노조 가입이 가능해지면서 비종사 조합원의 사업장 내 노조활동이 노사 간의 중요 쟁점으로 대두되었다. 이에 대한 입법으로 개정 노조법이 비종사 조합원의 사업장 내 노조활동에 관한 규정을 신설하였지만, 그 내용과 범위가 불분명하여 사업장 내 비종사 조합원의 노조활동에 있어 오히려 분쟁을 야기할 수도 있다는 우려를 사고 있다. 결국 개정 법 규정을 기존 판례와 사업장 내 노사관계 등을 고려하여 합리적인 방향으로 해석할 수밖에 없다. 종사 근로자의 범위는 노조법 상의 타 규정과의 통일적 해석을 위해 해당 사업장에 직접 근로관계를 형성하고 있는 자로 국한하여 해석하는 것이 타당하고, 비종사 조합원의 범위는 노조의 조직형태와 관계없이 해당 사업장에 종사하지 않는 조합원으로 해석하는 것이 적절하다. 비종사 조합원의 사업장 내 노조활동에 있어 가장 큰 쟁점은 역시 사업장 출입이라고 할 수 있다. 기존의 판례와 사업주의 시설관리권, 비종사 조합원의 노동3권의 조화로운 보장을 고려하였을 때 사업장 출입이 정당한지 여부는 출입 목적, 출입방식이나 절차, 출입으로 인한 사업운영 지장 발생 여부 등을 종합적으로 고려하여 판단하여야 할 것이다.
Abstract
As the revision of the union law allowed non-workers, including laid-off workers, to join unions by company, union activities of non-workers at workplaces have emerged as an important issue between labor and management. As a result of the legislation, the revised union law was set as a regulation on union activities in workplaces, but the contents and scope of the law are unclear, raising concerns that it may cause disputes over union activities of non-work members in workplaces. As a result, the revised law's regulations can only be interpreted in a reasonable way in consideration of existing precedents and labor-management relations in the workplace. It is understood that the most important thing for union members who are not engaged in the workplace is access to the workplace, and that the justification for entry is to be judged comprehensively by examining whether the purpose of entry is legitimate union activities, whether access methods or procedures are appropriate. Finally, if the entry of non-working union members is justified in union activities in the workplace, union activities are understood to be a matter that can be judged by the same standards as workers in the workplace.
