플랫폼 노동의 법제도적 쟁점과 대응방안에 대한 비판적 검토

4차 산업혁명과 경제의 디지털화에 따른 노동영역의 여러 문제들 중에서 최근 ‘플랫폼 노동’(platform work) 문제가 주목받고 있다. 플랫폼 노동은 플랫폼 경제를 토대로 빠르게 성장·확산되고 있는 일자리이지만, 동시에 노동의 유연화와 외주화의 극단화된 형태로서 이전의 임금노동과 비교할 때 고용안정성과 노동자의 법적 지위 측면에서 많은 문제점을 안고 있는 노동영역의 핵심 쟁점이다. 본 연구는 4차 산업혁명에서 플랫폼 노동이 부상하게 된 이유, 플랫폼 노동의 개념과 특성, 하위 유형 등을 살펴보고, 플랫폼 노동이 야기하는 노동문제의 전반적 지형과 쟁점을 고찰하고자 한다. 그리고 선진국과 한국에서 시도되고 있는 플랫폼 노동문제에 대한 법제도적 대응방안을 살펴보고, 그것의 타당성과 한계를 비판적으로 검토하고자 한다. 본 연구의 주장은 플랫폼 노동의 다양성과 변동성을 감안할 때, 단일한 법률적 규제만으로는 여기서 파생되는 노동문제를 다 해결하기는 어렵다는 점이다. 따라서 플랫폼 노동이 포괄하는 하위 고용유형별 특성을 고려하여 사안에 따라 다양하고 다차원적인 접근법이 시도될 필요가 있다. 여기에는 국제적·국가적 수준에서 추진되고 있는 ‘위로부터의’ 법제도적 대응방식은 물론, 플랫폼 노동자, 노동조합 및 시민사회, 플랫폼 산업부문 등 ‘아래로부터’ 제기되고 있는 조직화 및 거버넌스적 대응이 포함된다.
Abstract
In the age of the 4th Industrial Revolution, ‘Platform work’ has been recently paid attention to in academic and policy fields. While platform work, based on platform economy and technological innovations, has been a emerging job pattern increasing rapidly and expanding into various sectors, however, it has several serious issues and problems including stability of employment and worker’s legal status and social rights. This study attempts to examine concepts, features, and categories of platform work, and to explore legal issues and policy responses of platform work discussed in the developed countries and South Korea. Main arguments of this study are as follows. First, since platform work has internally characteristics of diversity and volatility, it is difficult to solve all labor problems of platform work only through general legal regulations. Second, in order to solve the labor problem of platform work, it is needed to establish multi-dimensional approaches including specific legal regulations, social security system, organization and empowerment of platform workers, and governance system of platform industry.
