스마트폰은 우리 인간의 삶에서 필수적인 도구가 되었다. 스마트폰을 이용한 온라인 거래가 활성화되어 있고, 이때에 우리는 대부분 앱을 이용하고 있다. 앱 이용은 비교적 쉽게 이루어지고 있으나, 앱 이용자의 법률관계는 비교적 복잡하게 얽혀 있다. 앱 이용자는 계약상대방으로서 앱 개발자와의 관계만 존재하는 것이 아니라, 그들 사이에 앱마켓사업자가 참여하거나 제3자가 참여하여 다수 당사자 사이의 거래로 이루어지는 특수성을 가지고 있는 것이다. 또한 앱 계약은 기술발달에 따라 출현한 새로운 유형의 계약으로서 그것이 우리 민법상 어떠한 전형계약에 해당하는지 분명하지 않다. 이때에는 앱이 우리 민법상 물건 개념에 해당하는지, 앱 이용자의 계약관계를 검토할 필요가 있다. 이 글은 앱 계약을 앱 이용자 측면에서의 관계를 중심으로 접근하면서 앱 계약의 법적 성질을 궁구하는 것을 목적으로 하고 있다. 이를 위해 우선은 앱의 의의 및 앱의 물건성에 관한 논의를 검토하였고, 앱 계약의 체결과정을 간단히 살펴보면서 앱 이용과 앱 내 결제에 대한 계약법적 측면에서의 법률관계를 살펴보았다.
Abstract
Smartphones have become an essential tool in our daily life. Online transactions using smartphones are active. And at this time, most of us are using the apps. Using the app is relatively easy. However, the legal relations of app users are relatively complicated. App users do not only have relationships with app developers who are contractual partners. It has the peculiarity of transactions between multiple parties with the participation of an app market operator or third parties. In addition, app contracts are a new type of contract that emerged with the development of technology. It is not clear what type of contract the app contract falls under under Korean Civil Act. Here, it is necessary to review whether the app corresponds to the concept of an object in Korean Civil Act and the contractual relationship of the app user. This article criticizes the app contract with the focus on the relationship in terms of app users. It aims to find out the legal nature of the app contract. For this purpose, first of all, the discussion on the significance of the app and the property of the app was reviewed. And I briefly looked at the process of signing an app contract. In addition, we looked at the legal relationship in terms of contract law for app use and In-App Purchases.
