지능정보사회에서 입법의 역할과 기능

초록
오늘날 4차 산업의 혁명시대의 도래와 함께 사물의 지능화, 자율화와 더불어 인공지능기술의 발달을 통하여 인간의 지적 능력 한계를 극복하여 경제산업구조가 지능정보기술 주도로 이루어지고 있다. 특히, 코로나사태로 인한 비대면(untact) 산업구조로의 재편을 통하여 그 속도는 더욱 가속화되고 있다. 결국, 컴퓨터와 인터넷이라는 제3차 산업혁명을 넘어 정보통신기술 뿐만 인공지능(AI) 기술이 접목되면서 지능정보사회로의 전환이 이루어지게 되었다. 이러한 지능정보사회는 지능정보기술을 바탕으로 미국과 유럽의 선진국을 포함한 각국은 새로운 기술과 산업에 획기적인 변화에 대응하기 위하여 다양한 연구와 함께 이를 뒷받침하기 위한 정책과 법률의 제정을 통하여 새로운 시대에 대한 대비를 착실히 진행해 나아가고 있다. 우리나라도 새로운 기술과 산업에 의한 패러다임의 혁신적 변화를 위해서 인공지능 등 지능 정보기술을 바탕으로 한 제4차 산업혁명시대에 대비하기 위해 각종 법률을 제정하고 있다. 따라서 정책적·입법적 차원의 의미에서 입법의 역할이 무엇인지, 입법의 내용에 관한 부분은 무엇인지와 함께 앞으로 논의되어져야 할 부분에 대해 관련 연구를 중심으로 살펴보고자 한다. 결론적으로 지능정보화기술과 지능정보화사회에 대한 대응은 대통령과 정부의 적극적인 의지에 의해서 지속적으로 발전되어 온 것이 사실이다. 하지만, 지능정보화 사회의 변화를 통한 우리의 미래를 예측해 본 바와 같이, 기술의 발달은 급속하게 발전하게 되고 그 변화에 따라 우리의 현재 생활과 미래의 변화는 주권자인 국민에게 편리함이라는 혜택과 함께 정보불평등, 사생활침해의 위험성, 일자리 변화, 이 모든 것에서 오는 불안감은 우리의 존재가치와도 관련이 있을 것이다. 입법부의 역할은 무엇인지, 권력통제를 강조할 것인지 아니면 보다 적극적으로 사회변화를 주도하는 역할을 할 것인지에 대한 진지한 고민이 필요할 것이다. 이러한 의미에서 입법의 역할과 기능에 대해서 생각해 보고자 한다. 이 모든 과정은 정부만의 역할이 아니라 입법의 주도적인 역할을 통해서 보다 발전된 방향으로 나아갈 수 있을 것이다.
Abstract
Today, with the advent of the revolution era of the fourth industry, the economic and industrial structure is led by intelligence technology by overcoming human intellectual limitations through the development of artificial intelligence technology. In particular, the pace is accelerating further through the reorganization of the non-face-to-face industrial structure due to the Corona crisis. In the end, beyond the third industrial revolution of computers and the Internet, artificial intelligence (AI) technology as well as information and communication technology was combined, leading to the transition to an intelligent information society. Based on intelligence information technology, countries including advanced countries in the U.S. and Europe are steadily preparing for a new era through various research and the enactment of policies and laws to support them. Korea is also enacting various laws to prepare for the era of the Fourth Industrial Revolution based on intelligent information technologies such as artificial intelligence for innovative changes in paradigms caused by new technologies and industries. Therefore, we would like to focus on related research on what should be discussed in the future, along with what the role of legislation is in the sense of policy and legislation. In conclusion, it is true that intelligence information technology and response to intelligence information society have been continuously developed by the active will of the president and the government. However, as predicted in our future through changes in the intelligent information society, technology advances rapidly, and changes in our current lives and future will be related to our existence, along with the benefits of convenience to the sovereign people. Serious consideration will be needed on what the legislature's role is, whether it will emphasize power control or play a more active role in leading social change. In this sense, I want to consider the role and function of legislation. The whole process will be able to move in a more advanced direction through the leading role of legislation, not just through the role of the Government.
