집단적 노동관계를 통한 플랫폼노동 종사자 보호 방안 - 노동조합의 역할을 중심으로 -

Recently, as platform work increases as a new form of employment based on digitalization of economy and technological innovations, it is increasingly argued how to protect platform worker’s unstable status of employment and vulnerable social rights. While related studies in South Korea mainly focused on whether legal regulation such like the Labor Standard Act can be applied to platform work, however, various studies in Europe have paid attention to organization model of platform workers suggesting self-protections through voluntary association, as well as legal and institutional regulations. This study attempts to examine social protection approach based on organization model and collective industrial relation in Europe, and to discuss what is needed to expand this approach into South Korea. Major arguments of this study are as follows. First, after reviewing the European experiences, we can categorize pseudo-trade union model, local solidarity model, and extension of trade union model as the organization strategies of platform workers. Second, for applying platform worker’s organization model into South Korea, it is needed to revise the labor laws disapproving industrial trade union and industrial bargaining.
