전쟁범죄에서 피해자의 적성(enemy character)과 일본군‘위안부’ 문제 - 국제형사재판소의 Ntaganda 사건을 중심으로 -

초록

일본군‘위안부’ 문제를 국제범죄의 체계 속에서 조망하려는 여러 선례들이 있어 왔으나 그 피해의 핵심적 성격을 구성하는, 식민지배 상황에서 자행된 반인권적 행위에 의한 피해를 어떻게 호명해야 할 것인지는 오래된 난제이다. 일본군‘위안부’ 문제에 대한 역사적인 연구가 상당한 성과를 내면서 축적되어 온 것에 비해, 그 법적 근거에 대한 연구는 상대적으로 활성화되지 못한 것도 이러한 점에 기인한 것이라고 본다. 위안부 피해의 성격을 정확하게 규명하고 이를 호명할 수 있게 되는 것은 단순히 사변적인 작업에 그치는 것이 아니라 실질적인 피해회복의 시발점이 될 것이라고 생각한다. 2019. 7. ICC가 선고한 Ntaganda 판결은 같은 집단에 소속된 구성원 상호 간에도 강간과 성노예화에 따른 전쟁범죄가 성립할 수 있다는 법리를 명시적으로 선언함으로써, 전쟁범죄의 성립에서 요청되던 적성요건을 완화, 극복할 수 있는 훌륭한 이론적 기초가 되었다. 위 판결은 강간과 성노예화에 따른 전쟁범죄의 경우 피해자의 형식적인 소속을 근거로 전쟁범죄의 성립을 부정할 수 없다는 메시지를 담고 있어 깊은 울림을 준다. 가해자인 일본군과 피해자인 조선인 위안부가 같은 집단에 소속되어 있기 때문에 일본군에 의한 체계적 강간 행위는 일본 국내법으로 해결해야 할 문제에 불과하고 전쟁범죄가 성립할 수 없다는 형식적 해석론에 더하여, 2차 세계대전 전후로 국제법질서의 형성을 주도하였던 국가들이 공유하고 있던 식민주의적 세계관의 존재로 인해 위안부 범죄는 전후 청산의 대상으로 진지하게 고려되지 못한 채 지속적인 불처벌 상태로 남아있었다. 그러한 점에서 Ntaganda 사건의 판시 내용은 위안부 범죄의 국제형사법적 구성에도 상당한 시사점을 준다. 이에 따라 향후에는 ICC의 Ntaganda 사건에서의 판시내용을 위안부 범죄의 법적 구성에도 반영하여, 그 법적 성격을 전쟁범죄로 관념하는 것이 충분히 가능할 것으로 전망된다. 일본군의 조선인 위안부에 대한 체계적인 성적 착취의 조직성, 집단성을 고려하면 이를 국제형사법상 전쟁범죄로 규율하는 것이 범죄의 속성에 부합하는 측면이 있다. 그런 점에서 국제형사재판소가 Ntaganda 사건에서 펼친 강간과 성노예화에 따른 전쟁범죄 성립요건에 대한 새로운 판시는 UPC/FPLC에 소속된 소년병 피해자들과 일본군 위안소에 배치되었던 위안부 피해자들의 취약성, 범죄의 구조적 유사성 등으로 인해 일본군‘위안부’ 문제를 전쟁범죄로 법적 구성하는 데 있어 정교한 이론적 토대를 제공할 수 있을 것이다

Abstract

While many studies have tried to address Japanese Military ‘Comfort’ Women issue in the system of international crimes, it still seems difficult to legally represent the damage caused by crimes against humanity in colonial situations. For this reason, studies regarding the legal characteristic of ‘comfort’ women were relatively stagnated compared with historical studies. Identifying the legal nature of damages by japanese military sexual slavery crime is not just speculative work, but will be the very starting point of substantial recovery. The judgment of The prosecutor v. Bosco Ntaganda by the International Criminal Court in July 2019 explicitly announced that members of the same military group can be victims of rape and sexual slavery war crimes, committed by members of the same group. The judgment surely can become firm theoretical base to overcome the ‘status requirement’ which has been required in war crime, and gives a deep impression as it delivers the message that war crimes of rape and sexual slavery can be established irrespective of the victim’s affiliation. Regarding the ‘comfort’ women issue, the systematic rape by Japanese military was technically regarded as national issue which should be regulated by Japanese domestic law, as japanese military and ‘comfort’ women victims were treated to be the members of the same country, since Korea was the colony of Japan. Furthermore, the colonial perspective shared by great powers after the second world war left the sexual slavery crime in impunity, and the damages became an ‘unfinished ordeal’. The judgment of Ntaganda case provides important implications regarding the legal charcteristic of ‘comfort’ women crime. According to the logic of the Ntaganda judgment, it seems possible to construct the ‘comfort’ women crime as war crime. Considering the systematic and organized character of sexual abuse against Korean japanese military ‘comfort’ women, it is desirable to regulate the act by war crime, as it more appropriately reflects the attribute of the crime. Comparing the vulnerability and structural similarity of crime against child soldiers in UPC/FPLC with Korean japanese military ‘comfort women’ case, Ntaganda Judgment will be a significant base to identify legal characteristic of ‘comfort women’ issue.
