State examinations in the living room -The legal and ethical limits of AI supported online proctoring systems-

The SARS-Cov2 pandemic is forcing universities to change locations: academic work is taking place at home, in the so-called “home office”, because of contact restrictions. Although students, and professors/lecturers in particular, are considered capable of using digital media to maintain university operations, it is challenging from a legal point of view to turn the home into a lecture theatre. Above all, the design of electronic examinations in the private sphere must be reconciled with equal opportunities and data protection. This can be achieved by trusting students and rethinking the meaning of examinations. Despite the justifiability of digitisation, the new normal should focus on the human element, combining digitality and humanity. This is not compatible with the use of artificial intelligence to detect attempts at deception in electronic exams sat at home.
