국제결혼 안내프로그램에 대한 국제인권법적 검토: 국적에 의한 차별금지와 가족결합권을 중심으로
The International Marriage Guidance Program from the Perspective of International Human Rights Law: In Light of Non-discrimination based on Nationality and Right to Family Unification

특정 7개국(중국, 베트남, 필리핀, 캄보디아, 몽골, 우즈베키스탄, 태국) 출신의 외국인과 혼인한 한국인은 국제결혼 안내프로그램을 이수해야 외국인 배우자에게 결혼이민(F-6) 목적의 입국사증이 발급된다. 이 글은 국제결혼 안내프로그램에 대해 국제인권법의 관점에서 분석한다. 먼저 인종차별철폐협약이 국적에 근거한 차별을 금지하는지에 대해서는 해석론이 나뉘지만, 자유권규약은 국적에 의한 차별을 금지하는 것으로 해석되고 있다. 특정 국가를 선정한 기준이 합리적인지 살펴보면, 이 프로그램은 이혼율이 높거나 한국국적을 다수 취득한 국가, 미등록이주민이 많은 국가를 기준으로 한다고 밝힌다. 하지만 특정 7개국은 그러한 기준을 바탕으로 선정되지 않았으며, 교육의 내용에 고정관념을 양산하는 인권침해적 요소가 있다. 두 번째로, 자유권규약 제23조는 출입국 영역에서 다른 가족 구성원이 한 국가에 입국하고 거주할 권리인 가족결합권을 보호한다. 가족결합권 침해여부는 개별적인 사안에서 판단하지만, 특정 국적의 혼인에 대해 프로그램의 이수를 강제하는 것은 가족생활에 대한 과도한 개입이 될 여지가 있다. 국제결혼 안내프로그램은 실질적으로 결혼중개업체를 통한 혼인을 규율하기 위한 것으로 보이는데, 그 폐해를 직접적으로 시정하는 정책을 강구하는 것이 더 적절하다. 프로그램의 이수를 입국사증의 발급요건으로 의무화하는 것은 외국인 여성의 체류자격을 한국인 남성에게 의존하게 하는 문제도 있으므로, 이러한 요건은 재검토되어야 한다.
Abstract
Certain Korean nationals are to take a four-hour course of the ‘International Marriage Guidance Program.’ It is mandatory for Korean nationals married to a person from one of the seven countries: China, Vietnam, Philippines, Cambodia, Mongolia, Uzbekistan, and Thailand. For others, it is not a mandatory condition for the issuance of a marriage migrant visa(F-6). This paper reviews this Program from the perspective of international human rights law. First, the differential treatment of the Program is not based on reasonable and objective criteria in selecting seven countries. Second, Article 23 of the ICCPR protects the right to family, including the right to family unification. While whether it breaches the right to family unification would depend on the specific circumstances of each couple, the Program systematically offers differential treatment that highly affects the family life of international couples. The Program, thus, should be reviewed to protect from discrimination and to respect family life of international spouses.
