무역과 노동의 연계에 관한 국제적 논의는 미국과 EU 등 선진국 주도의 FTA를 중심으로 발전하였다. 미국과 EU가 체결한 FTA들은 모두 한국과 체결한 FTA에서 무역과 노동의 연계에 관한 가장 최신의 경향을 구축하였으나 최근 등장한 CPTPP와 USMCA는 한-미 FTA나 한-EU FTA상의 내용을 한층 더 보강하여 더욱 발전된 형태의 노동 장을 포함하였다. 특히 USMCA는 노동권의 집행 조항상 무역영향성 요건의 정의를 도입하고 입증책임을 전환함으로써 한층 진화된 양상을 보여주고 있다. 이에 본고에서는 최근 도입된 CPTPP와 USMCA 노동 장의 변화 양상을 살펴보고, USMCA 노동 장에서 확인되는 미국의 입장과 그에 따른 시사점을 도출한다. 특히 FTA 노동 장에 기초한 최초의 분쟁이라 할 수 있는 과테말라-미국 중재사건에서의 주요 쟁점에 대한 분석을 통해 노동권의 집행 조항 및 무역영향성 요건에 대한 해석 지침을 도출하고, USMCA 노동 장의 주요 특징이라고 할 수 있는 입증책임 전환의 문제에 대해 구체적으로 살펴본다.
Abstract
International discussions on the link between trade and labor developed around FTA led by developed countries such as the United States and the EU. CPTPP introduced a more enhanced form of Labor Chapter, and the most recently adopted USMCA has further evolved by introducing a definition of trade effect requirements in the enforcement provisions and shifting the burden of proof. This paper examines the changes in the recently introduced CPTPP and the USMCA Labor Chapter, and draws on the US position identified in the USMCA Labor Chapter and its implication. In particular, by analyzing major issues in the Guatemala-US arbitration case, which is the first conflict based on the FTA Labor Chapter, the author provides interpretation guidelines for labor rights enforcement provisions and trade impact requirements, and examines the features and implications of the shift of burden of proof.
