외국시민보호명령의 승인 및 집행에 관한 헤이그국제사법회의의 동향 연구

There is a considerable international, regional and national attention these days in the issue of establishing the appropriate civil protection order regime for a victim or a potential victim of domestic violence or harmful interpersonal behaviour in other types. Accordingly, this study is being examined a trend from various angles that the Hague Conference on Private International Law has progressed so far regarding the recognition and enforcement of foreign civil protection orders that was executed in diverse cases including a problem of domestic and family violence. First of all, in terms of inquiring into a Preliminary Note pertinent to the Recognition and Enforcement of Foreign Civil Protection Orders, it is being reviewed case studies of victims, main features of and variations in national protection order regimes, proposed and existing national and regional models of cross-border recognition and enforcement of civil protection orders, applicability of regional or national models to the international level, and suggestions for possible next steps. Subsequently in relation to arranging the Questionnaire on the recognition and enforcement of foreign civil protection orders(Summary of Member responses and possible ways forward), it is being addressed the civil protection order regimes and types of orders available, civil protection order enforcement issues, current national recognition and enforcement of foreign civil protection orders and domestic establishment of civil protection orders by foreigners, regional and international instruments, civil protection orders in the context of the 1980 Hague Child Abduction Convention and the 1996 Hague Child Protection Convention, views on a potential future international instrument in the area of civil protection orders, additional information from international organizations, informal NGO(non-governmental organization) consultations, and the possible ways forward and further work. And then, conclusions and recommendations of the experts’ group and information supplementary to conclusions and recommendations(summary of meeting discussion) are being understood through the Report of the Meeting of the Experts’ Group on the Recognition and Enforcement of Foreign Civil Protection Orders. Finally, with regard to presenting the Additional Statistical and Comparative Information on National Law concerning the Recognition and Enforcement of Foreign Civil Protection Orders, it is being covered the specific statistical information and additional comparative information on national law using the Draft Country Profile. In this way, a research and a discussion of the Hague Conference on Private International Law pertinent to the Recognition and Enforcement of Foreign Civil Protection Orders are predicted to be likely developed more deeply and actively down the road. It is considered that there is a need to share the importance of a role in future international organization with regarding it as a global main issue as for the appropriate civil protection order regime in each country for a victim of domestic violence or of other types of harmful interpersonal behaviour in the era of internationalization.
