네팔의 사법제도와 법률가양성교육

This thesis examines the structure of the judicial system in Nepal, the qualifications and characteristics of its members, and analyzes the legal education that supports it. An overview and sketch of Nepal's judicial system are drawn through literature analysis on the constitutional enactment in 2015 and changes in the legal system. Although Nepal is a federal state, its judicial system has an integrated structure with the Supreme Court as its apex. As Nepal is in the process of transitioning from an authoritarian to a democratic system, the judicialization of politics is taking place. In this perspective, the judiciary plays an active role in issues like human rights and the environment. In addition, it can be evaluated that the influence of the Anglo-American law that came through India and the monarchy which had been remained approximately 30 years ago is still influencing today. The constitution of the judicial body is filled with judges in a state of overlapping human resources in the administrative and judicial branches. However, efforts are being made to ensure democratic legitimacy in appointing judges. Changes in the governance system in Nepal can be outlined through changes in the authority to appoint judges in the judicial body. The most important feature is that the unification of the legal profession is based on the Bachelor's degree in Law. Legal professions in Nepal are unifying from the basis of the qualifications of a bachelor's degree in law, and the Judge of the Supreme Court is the final destination for the legal profession. The education for the Bachelor of Laws is in charge of the universities and is being fostered through the LL.B. and the B.A.LL.B.
