국제연맹규약의 위임통치제도에 대한 비판적 검토

A Critical Analysis of the Mandate System in the Covenant of the League of Nations

초록

위임통치제도란, 제1차 세계대전 승전국 중 위임통치 권한을 부여받은 국가들이 국제연 맹을 대신해 패전국인 독일 식민지와 오스만제국 일부 영토를 위임받아 통치했던 제도를 의미한다. 이 연구에서는 위임통치제도가 식민지 제도와 큰 차이가 없었다는 평가를 받는 이유를 규명하고자 하였다. 먼저, 국제연맹규약 제22조에 규정된 위임통치 주체와 대상 지역을 검토하고, 이 제도의 주요 원칙에 해당하는 문명의 신성한 사명 원칙의 법리를 살펴보았다. 다음으로, 위임통치 제도와 15세기 말부터 유지되고 있었던 식민지 제도의 비교를 통해, 당시 국제법상 이 제도 창설의 의미를 두 가지 측면에서 살펴보고, 제도 내 문제를 비판적으로 검토하였다. 위임통 치제도 내에서 발생한 첫 번째 문제는 식민지 모국에 완전한 주권이 있었던 식민지 제도와 달리, 위임통치국에 주권이 부여되지 않았음에도 불구하고, 위임통치국이 자신이 담당한 위임통치지역에 대한 주권을 주장한 것이다. 두 번째 문제는 식민지 제도와 달리 위임통치 제도는 위임통치국에 문명의 신성한 사명 원칙에 따른 실체적·절차적 의무를 부여했음에도, 위임통치국이 해당 의무를 위반한 것이다. 위임통치국의 실체적 의무 위반 사례로 뉴기니 파푸아와 나우루에 대한 인민의 복지와 발전을 도모할 의무 위반, 서남아프리카에 대한 인종차별정책 및 남양군도에 대한 민족말살정책, 이라크 내 인종적·언어적·종교적 소수민 족의 보호 문제와, 팔레스타인 지역에 원래 거주하고 있었던 아랍인과 이 지역에 정착한 이민자인 유대인의 보호 문제를 검토하였다. 또한, 위임통치국의 절차적 의무 위반 사례로 청원서 제출 절차상 문제와 연례보고서 제출 의무 이행 시 문제를 살펴보았다. 위임통치제도에 대한 비판적 검토를 통해 두 가지 결론을 내릴 수 있다. 먼저, 위임통치 지역의 주권이 위임통치국에 부여되지 않았음에도, 위임통치국은 이 지역에 대한 주권을 주장하고, 실체적·절차적 의무를 위반하였다. 이로 인해 위임통치제도는 식민지 제도와 다를 바 없는 결과를 초래하였다. 다음으로, 위임통치제도는 해당 지역의 주권을 위임통치 국에 부여하지 않았으며, 다자조약인 국제연맹규약 제22조에 위임통치국의 의무를 명시적 으로 규정했다는 점에서, 식민지 제도와는 분명한 차이가 있었다. 따라서 이 제도의 창설 을 국제법의 탈식민화 과정으로 이해할 수 있었다.

Abstract

The countries that emerged victorious from World War I established the mandate system, codifying it in Article 22 of the Covenant of the League of Nations. This study analyzes whether the mandate system was a modified colonial system or whether it helped end colonialism. First, the study explains the structure of the mandate system by reviewing which countries Article 22 deemed mandatory powers and where it established mandated territories; it also discusses the “sacred trust of civilization” principle behind the mandate system. Second, the article critically reviews the problems within the system after examining in two aspects the meaning of the system's creation under modern international law by comparing the mandate system with colonial one. The first problem is that although, unlike the colonial system where mother countries had full sovereignty over colonies, the mandate system did not grant mandatory powers sovereignty, the mandatories still claimed sovereignty over their mandated territories. The second problem is that while the system gave mandatories substantial and procedural obligations, they violated these obligations. The article reviews cases of violations of substantial obligations such as violations of the well-being and development of the peoples of Papua New Guinea and Nauru, apartheid in Southwest Africa, the national annihilation policy for Micronesia, the protection of ethical, linguistic, and religious minorities within Iraq, and the protection of Arab and Jewish populations in Palestine. It also reviews cases of violations of procedural obligations such as the problem of the implementation of obligations for annual reports and petitions. Through its critical review of the mandate system, this article reaches two conclusions. First, even though sovereignty was not granted to the mandatories, the mandatories claimed sovereignty over the mandated territories and the mandatories’ violations of their substantial and procedural obligations meant that the system did not differ significantly from the colonial one. Second, the mandate system differed from the colonial system in that it did not give sovereignty to the mandatories and explicitly stipulated the mandatories’ obligations in Article 22. Therefore, the creation of the system could be understood as progress in the decolonization of international law.
