온라인 게임머니 불법환전의 행위태양 분석과 처벌규범에 대한 검토

온라인 게임은 국가경제의 한 축을 이루는 미래 성장동력의 산업이자 일반인의 여가활용을 위한 문화콘텐츠로서의 긍정적 기능을 가지고 있다. 그러나 온라인 게임은 그 부정적인 측면으로서 게임에의 과몰입으로서 이른바 게임중독의 문제, 폭력성이나 선정성이 강한 게임물에 의해 아동·청소년에 악영향을 끼치는 문제, 게임물을 이용하여 실질적으로 도박행위와 유사한 금전거래가 이루어지는 사행행위화의 문제 등이 사회적 이슈로 되어 있다. 이 중 온라인 게임물의 사행성에 대한 규제는 이른바 웹보드게임이 그 핵심적인 대상의 하나가 되어 왔다. 온라인 게임머니 등의 불법환전의 근절을 위해서는 근본적으로는 게임물의 사행성에 대한 규제법규의 전체적인 체계를 재검토해보고, 불법환전과 관련하여 이에 가담한 행위태양 별로 구체적으로 어떠한 형사처벌이 가능한지에 대하여도 이론적 검토가 필요하다. 나아가 불법환전업에 대한 현행법상의 규제 및 처벌이 범죄의 예방이나 재발방지의 측면에서 적정한지 여부 등을 살펴볼 필요가 있다. 이러한 문제 인식과 이해를 바탕으로 본 연구에서는 웹보드게임을 중심으로 논란이 되고 있는 사행성 문제에 초점을 맞추어 관련 규제법제의 전체적인 체계를 검토해보고, 특히 온라인 게임머니의 불법환전에 대한 처벌규범을 검토하는데그 목적을 두고 있다. 이러한 목적을 바탕으로 서론 이하에서 먼저 온라인 게임머니 불법환전의 현황과 관련하여 웹보드게임 규제의 연혁을 포함하여 관련 범죄통계와 적발사례 등을 살펴본 후, 온라인 게임머니의 불법환전에 있어서그 구체적인 유형별로 행위태양을 분석하고 형법상 도박죄의 적용 여부를 검토해보았다. 그리고 불법환전에 가담한 행위태양별로 그 구체적인 형사책임을 규명하는 차원에서 수사와 재판 실무에서 불법환전에 대해 구체적으로 어떠한 처벌규범을 적용할 수 있을지를 살펴보았다.
Abstract
Online gaming has positive functionality as a future growth engine industry and cultural content for general public leisure. However, online games have negative aspects such as the problem of game addiction caused by overindulgence, the problem of adversely affecting children and adolescents by violent or pornographic games, and gambling. Among them, regulations on the gambling of online games have made web board games one of its key targets. In order to eradicate illegal converting into money of online web-board game money, the overall system of regulation laws on the gambling of games should be reviewed. And theoretical review is also needed on what criminal penalties are available specifically for each sun involved in illegal converting into money. Furthermore, it is necessary to examine whether legal regulations and penalties for illegal converting into money businesses are appropriate in terms of prevention or prevention of recurrence of crimes. Based on this problem recognition and understanding, this study aims to review the overall framework of regulatory legislation, particularly the penal norms for illegal currency exchange. Based on this purpose, we first look at related crime statistics and cases of investigation, including the history of web board game regulations. Then, we analyzed the behavior by type in illegal converting into money and reviewed the application of gambling crimes under criminal law. We also looked at what specific punishment rules could be applied for illegal converting into money in the fields of investigation and trial.
