이 연구는 민법, 특히 상속법의 제・개정과정에서의 경과규정의 의미를 밝히고 신법과 구법의 시적 적용범위가 문제되었던 개별사건에 대한 법원의 입장을 검토하기 위하여 수행되었다. 이를 위해 시제사법의 선행연구들을 살펴보았고, 이를 기반으로 대법원의 경과규정에 관한 판결례를 분석하고 검토하였다. 상속에 있어 경과규정은 이른바 상속개시시법주의가 원칙이다. 상속으로 인하여 발생한 기득권을 보호하기 위한 것이다. 따라서 상속과 관련한 문제라 할지라도 상속 그 자체에 의해 발생하는 기득권과 무관하다면 상속개시시법주의를 관철해야 할 이유도 정당성도 없다. 개별 상속제도들을 각론적으로 검토하여 각 제도의 특징들을 포착한 후 그 특징에 맞게 경과규정을 해석해야 비로소 바람직한 결과를 도출할 수 있을 것이다. 한편 이와 관련하여 법률불소급의 원칙과 기득권이론은 경과규정의 입법과 해석의 측면에서 여전히 유용한 도구가 된다. 또한 권리존속의 규칙도 하나의 원리로 고려될 수 있다. 물론 이때 새로운 법에 따라 권리의 내용이 변경되어야 한다는 요청은 여러 요소들의 비교형량을 통해 정당화될 수 있다. 예컨대 개정법질서의 공공성의 정도, 권리자의 신뢰이익, 권리 변경의 본질성 여부, 동시대 복수 수범자들 사이의 평등 등이 고려요소가 된다.
Abstract
The purpose of this article is to clarify the meaning of transitional provisions in the process of enacting and amending the Civil Act(especially the Inheritance Act). In this study, I reviewed precedent studies of intertemporal law, and analyzed the Supreme Court's cases about transitional provisions. In the case of inheritance, as a rule, the law at the time of the inheritance should be applied. This is to protect the vested interests by descent. Therefore, if a case is evaluated to be irrelevant to vested interests by inheritance, deferent conclusions can be drawn. In this study, an attempt was made to interpret transitional regulations according to the characteristics of individual inheritance-related systems. The principle of prohibition of retroactive law and the theory of vested interests are useful tools in the interpretation of transitional provisions. But the rights granted by prior law are not permanent. Rights may be restricted or altered by several factors such as public interests, trust of the right holder, degree of restriction and principle of equality.
