EU의 공정하고 공평한 통상정책에 대한 고찰 : TDI와 CBAM을 중심으로

Over the past three years, the EU actively pursues fair trading environment and a level playing field in trade. First, the EU develops a new method, significant distortion, to make more active use of its trade defense instruments. In particular, domestic regulation was amended to include labor-related standards when the EU determines the existence of dumping. Furthermore, the EU announced a plan to implement new policies that can deal with so-called carbon leakage problem, such as Carbon Border Adjustment Mechanism, CBAM. These measures would lead to a debate over how social or environmental value should be taken in to account under the current GATT/WTO regime. Usually non-economic values have been discussed based on the notion of ‘a fair and level playing field in trade’. However, WTO members has not been made a coherent and harmonized position what is a fair trade and level playing field in trade, applying different criteria which reflect imported country’s own interest. Therefore, the WTO has to be a forum to establish the concept of fair trade and level playing field in trade at the multilateral level. to prevent new protectionism.
