경로의존성과 관료정치 그리고 입법성공: 유전자원법 입법과정의 분석

Korean government and members of National Assembly have tried to fail in legislating the Act on the Access to Genetic Resources and the Fair and Equitable Sharing of the Benefits since 2012, but succeeded in legislating the Act in 2016. The purpose of this study is to analyse the causes and factors of legislative failure in the 19th National Assembly Session, and legislative success of the Act on the Genetic Resources in the 20th National Assembly Session. I found that path dependency of bureaucratic politics of related actors influenced legislative failure and success of the Act on the Genetic Resources even though related experts evaluated the dispersed genetic resources management system inefficient for the industrial interest groups, and in terms of foreign benchmarking model suggesting integrated management system. Structural changes were rejected in the 19th National Assembly Session, and present structural dispersion type accepted and continued because of the lock-in effect without critical junctures since 2012. So I suggest that the Act on the Genetic Resources should be implemented to coordinate the functions among related six different governmental actors and enterprises by means of Genetic Resources Information Center.
