국방 지식재산권의 소유관계 변화에 따른 국방과학기술혁신 촉진법 개선방안 연구

Defense Research and Development refers to 'one of the methods of acquiring weapons systems; it is a method of technology that we do not possess, either alone or in cooperation with foreign countries, and producing and acquiring the necessary weapons systems by putting the researched technologies into practical use'. In the past, intellectual property rights acquired by Defense Research and Development were owned in accordance with the 「DEFENSE ACQUISITION PROGRAM ACT」 and the 「ENFORCE DECREE OF THE DEFENSE ACQUISITION PROGRAM ACT」. On the other hand, with the recent enactment of the 「DEFENSE SCIENCE AND TECHNOLOGY PROMOTION POLICY ACT」, ownership of intellectual property rights changed according to the subject of Defense Research and Development. This study compared the definition and classification of Defense Research and Development changes according to the enactment of the「DEFENSE SCIENCE AND TECHNOLOGY PROMOTION POLICY ACT」with the previous 「DEFENSE ACQUISITION PROGRAM ACT」. A study of the change in defense intellectual property rights following 「DEFENSE SCIENCE AND TECHNOLOGY PROMOTION POLICY ACT」was conducted.
