The Main Contents and Evaluation of the Employment Insurance Act for Artists and Special Type Workers

Recently, there have been two major changes related to the coverage of the Employment Insurance Act(EIA). The first change is the partial revision of the EIA on 9 June 2020 (Act No. 17429, Enforcement 2020. 12. 10.). The first change is to partially amend the EIA on 9 June 2020 (Act No. 17429; Enforcement No. 12. 10.), which stipulates that “Artists” are subject to the EIA. The second change is the partial revision of the EIA on January 5, 2021 (Act No. 17859, Enforcement No. 7. 1, 2021 and 21. 5.), which stipulates that “Special Type Workers” are subject to the Employment Insurance Act. This paper tries to review provisions of the Employment Insurance Act for Artists and Special Type Workers who are the newly insured persons, and raises some issues as belows that need to be discussed. The first issue is the dilemmas about the application of IEA to Artists and Special Type Workers through a special system based on employees. The second issue is the concepts of Artists with a contract of less than a month(=short-term Artists) and Special Type Workers with a contract of less than a month(=short-term Special Type Workers). The third issue is regarding the determination of legal status of the insured person. Fianl issue is regarding the necessity to recognize the concept of partial unemplpyment with the approval of multiple insured status.
