다중결합제품의 특허침해 사건에서 손해배상액 추정규정과 기여율의 체계적 해석에 관한 고찰

침해된 특허가 제품의 일부에만 적용되는 다중결합제품에 관한 특허침해 사건에서 손해배상액 산정이 문제 된다. 다중결합제품에 침해된 특허 이외의 다른 특허권, 상표권, 디자인권 등 제3의 독점적 권리가 적용된 경우 손해배상액 추정규정으로 산정된 손해배상액에 다른 특허권 등의 가치가 포함될 수 있다. 이로 인하여 우리나라는 ‘기여율(또는 기여도)’을 적용하여 해결하고 있고, 일본의 판결도 ‘기여율’을 적용하고 있으며, 미국은 배분의 원칙과 전체시장가치규칙 및 이와 관련된 이론으로 해결하고 있는 것으로 보인다. 우리나라의 특허법상 손해배상액 추정규정의 적용과 기여율의 관계에 관한 이론에 불분명한 점이 존재하므로, 그 체계적 해석을 명확하게 규정하기 위하여 미국의 이론들과 일본의 판례, 우리나라의 책임제한 법리에 관한 판결들을 검토한다. 이에 따르면, 우리나라 특허침해 사건에서 적용하는 기여율은 특허법상 손해배상액 추정규정의 해석론이 아니라 책임제한 법리의 성격을 가진다고 보는 것이 타당하다. 아울러 기여율 고려의 필요성, 참고할 요소들, 방법적 한계 등도 함께 살펴본다.
Abstract
The calculation of damages is problematic in patent infringement cases involving multi-component products, in which the infringed patent applies only to a part of the product. Third-party exclusive rights, such as patents, trademarks, and design rights other than infringed patents, may be applied to the product. To solve this problem, Korea is applying the “contribution rate(or apportionment ratio)” and Japan’s ruling is also applying the “contribution rate”, and the U.S. seems to be resolving the apportionment rule, the entire market value rule, and related theories. Since there is something unclear about the application of damages estimation regulations and the relationship between contribution rates under our patent law, we review American theories, Japanese precedents and rulings on Korea’s liability-restriction laws to clarify the systematic interpretation. Following the review of systematic interpretation, the need to consider contribution rates, factors to refer to, and methodological limitations are also examined.
