미래세대를 위한 메타버스(Metaverse)의실효성과 법적 쟁점에 관한 논의

초록
오늘날의 코로나바이러스(COVID-19)는 정치, 경제, 사회, 문화 등 많은 영역에 영향을끼쳤다. 비대면 방식이 일상의 패턴이 되고 있는 현 시점에서 새로운 대안으로서 사람들간의 교류와 감염병 예방, 이 두 가지를 모두 충족할 수 있는 메타버스에 전 세계의 이목이집중되고 있다. 모바일 디바이스 및 네트워크 기술 등의 발전과 산업 간의 융합을 통하여사람들이 언제 어디서나 가상세계에 접속하여 다른 이용자들과 교류할 수 있게 되면서 현실의 시·공간을 초월한 ‘또 하나의 생태계’가 등장하게 된 것으로 평가되기도 한다. 메타버스는 기존의 사이버 공간과는 달리, 이용자가 가상 세계에서 현실과 동일하게 사회·경제·문화 활동을 할 수 있는 플랫폼이라는 점에서 큰 차이가 있다. 이용자는 메타버스 내에서자신의 아바타를 통해 다른 이용자와 상호 작용할 수 있을 뿐만 아니라, 스스로 창작한 콘텐츠 또는 기존의 콘텐츠를 이용·유통하여 오프라인에서와 동일하게 경제활동을 할 수 있다. 따라서 현재의 흐름을 파악하고, 미래를 대비하기 위해 그 실체에 대한 파악과 실현 가능성, 법적 쟁점 파악, 법적 제언 등 법리적인 관점에서 본 연구를 진행하고자 한다. 이를위해 먼저 메타버스가 무엇인지 전반적으로 개관해보고, 메타버스가 실현가능한 것인지,그 한계점은 무엇인지 등 법적인 쟁점사항에 대해 구체적으로 살펴본다. 다음으로 본 연구의 결론이자 핵심적인 사항으로서 미래세대를 위한 메타버스의 정립(正立)이 이뤄질 수 있도록 법적 제언으로 이어간다. 그런데 결국 메타버스 플랫폼도 데이터가 없이는 유명무실해질 수밖에 없는 것이 자명하다. 왜냐하면 그 안에서 이뤄지는 모든 관계, 행위 등은 정보의 활용과 보호라는 것과 반드시 결부되며 이를 통해 순기능과 역기능이 동시에 발생하는것이기 때문이다. 이것은 인공지능, 스마트시티, 자율주행자동차 등 다른 분야도 마찬가지다. 따라서 결론에서는 데이터의 활용과 보호 측면에서 현재 논의가 되고 있는 관련 개정안및 기본법안에 대해 분석하고 개선방안을 제시하도록 한다.
Abstract
Today's coronavirus has afected many areas, including politcs, economy, society, andculture. As non-face-to-face methods are becoming a daily routine, the world's atentionis focused on the Metaverse, which can satisfy both people-to-people exchanges andinfectious disease prevention as a new alternative. Through the development of mobiledevices and network technologies and the convergence betwen industries, people canaces the virtual world anytime and anywhere and interact with other users, creatingan ecosystem that transcends time and space. Unlike the existing cyberspace, Metaverseis a platform that alows users to engage in social, economic, and cultural activites inthe virtual world just like in reality. Therefore, in order to prehension the curent trend and prepare for the future, weintend to conduct research on the identifcation and feasibilty of its substance,identifcation of legal isues, and legal proposals. To this end, we first give an overviewof what the metaverse is, and lok into specifc legal isues such as whether themetaverse is feasible and what its limitations are. Next, as the conclusion and key pointof this study, it continues with legal proposals so that the metaverse can be established for future generations. In particular, in terms of data utilzation and protection, weanalyze the relevant amendments and framework bil curently being discused andsugest improvement measures.
