토지이용관리법제와 공간정보법제의 연계성 분석 및 개선방안
Connectivity Analysis between Spatial Information Legislation and Land Use Legislation

초록
공간정보의 작성규정 중복방지, 수요-공급 선순환 촉진 등을 위하여 토지이용관리법제와 공간정보법제의 연계가 필요하다. 이와 관련하여 토지이용관리법제 124개를 행(row)에, 이 법제에서 규정하는 공간정보 적용유형 9개를 열(column)에 배치한 2-모드 장방형 메트릭스(rectangular matrix)를 만들고, 2-모드 네트워크 분석(network analysis)을 적용하여 두 법제 사이 네트워크의 연결 정도 및 중심성을 도출하였다. 이를 통해 다음과 같은 사실관계와 시사점을 확인하였다. 첫째, 토지이용관리법제 모든 법령은 공간정보 적용을 규정한다. 둘째, 토지이용관리법제에 공간정보 적용수요가 있으나, 이 수요를 공간정보법제가 충족시키는데 한계가 있다. 셋째, 토지이용관리법제에 추상화 수준이 다른 공간정보 수요가 있으나, 축척이 다른 공간정보 사이 일관성/일치성 확보를 위한 제도적 장치가 없다. 넷째, 토지이용관리법제는 복수 유형으로 공간정보를 적용하고, 묵시적 방식을 더 많이 이용하고 있으며, 이와 관련하여 명시적인 적용 혹은 준용이 용이하도록 공간정보법제의 개선이 필요하다. 다섯째, 공간정보법제 이외 법령의 공간정보 적용 규정을 따르는 법령도 있으며, 이와 관련하여 공간정보 적용수요를 중심으로 하는 법제 연계체계 정립이 필요하다. 이상과 같은 과제를 해결하기 위해 본 연구는 공간정보법제가 충족시켜야 할 공간정보 적용수요와 추상화 수준수요를 중심으로 수요맞춤 기반 프레임워크, 프레임워크 기반 주제공간자료 생산체계, 공간자료 일반화 및 일관성 체계를 개선방안으로 제시한다. 그리고 다양한 법령에서 공간정보 적용을 위한 법제 연계체계 개선방안으로 공간정보법제 중심의 다층 법제 네트워크 구축을 제시한다.
Abstract
Geospatial information legislation and land use legislation should be connected to each other to prevent duplicate articles of geospatial data production and to promote virtuous cycle of spatial data supply-demand. We created rectangular matrix with 124 laws on the land use legislation on rows and 9 types of geospatial data application regulated by those laws on columns. We then conducted 2-mode network analysis to calculate the connectivity and centrality between these two dimensions. The analysis result confirms the connectivity between the legislations and its implications, as follows: (1) all laws in the land use legislation define geospatial data application, (2) geospatial data application defined in the land use legislation is not fully identified in the geospatial information legislation, (3) land use legislation specifies the need for geospatial data in multiple scale, and geospatial information legislation lacks regulation to secure the consistency between geospatial data in different scale, (4) land use legislation identifies multiple types of geospatial data application using related terminologies without fully defining them, and finally (5) some laws in land use legislation refers to geospatial data application defined by legislations other than the geospatial information legislation. Based on these findings, this paper suggests three improvements defined by demand types of application and scale, including a customization based framework, framework based the guideline for thematic geospatial data production, and generalization standard and consistency system of geospatial data. It also suggests establishing a geospatial data legislation-centered multi-level legislation network.
