The Spread of COVID-19 and State Responsibility : Legal Obligations for Notification and Information Sharing in a Pandemic

코로나 19 팬데믹이 지속적으로 확산됨에 따라 바이러스 최초 발원지 및 전파지로 평가 되는 중국의 국가책임 문제가 여러 루트로 활발하게 논의되고 있다. 그 동안 중국이 발원 지이자 전파지이므로 이로부터 초래되는 법적 책임을 부담하여야 한다는 단순하고 편의적 인 시각에서 이 문제에 대한 논의가 주로 전개되어 왔다. 그러나 IHR 2005 관련 규정과 관습국제법상 영토 관리와 통보 의무라는 관점에서 살펴보면 이 사안은 그렇게 단순하게 평가할 수 있는 것은 아니다. IHR 2005는 코로나 19와 같이 전례없는 팬데믹을 염두에 두고 도입된 조약은 아닌지라 새로운 상황을 규율하고 통제하는 데에 빈틈이 적지 않다. 또한 관습국제법상 초국경적 활동에 수반되는 관리와 통보 의무에 대한 기존 판례와 논의 를 살펴보면 이들 법리가 코로나 19 상황에는 그대로 적용될 수는 없다는 점을 시사한다. 이러한 한계를 극복하기 위해서는 궁극적으로 새로운 조약 체결이나 IHR 2005 개정 작업 등이 필요하다. 전반적으로 국제법 측면에서 팬데믹 상황을 효율적으로 규율할 수 있는 새로운 규범 도입과 법리 발전이 시급하다.
Abstract
Entering the 21st month as of September 2021, COVID-19 is still engulfing the entire global community. Mindful of the fact that China was the originating place of the virus and that its failure to contain the virus in the early stage of the disease has caused the pandemic, discussions to place state responsibility on China have been robust in various fora. State responsibility in this respect can stem from two sources of international law: IHR 2005 and customary international law. Both sources of law, however, invite complex evaluations and pose difficult questions. First of all, IHR 2005 is not detailed enough to impose specific obligations on states commensurate with the demands from the international community in the early stage of a pandemic. This phenomenon is not surprising because IHR 2005 was introduced without experiencing a pandemic with the scale and impact of the ones like COVID-19. On the other hand, customary international law imposes legal obligations on each state to manage its territory with due diligence and notify neighboring states of transboundary harm when one is suspected. These customary law obligations, however, presuppose a physical flow of moving particles or something similar to it, which does not necessarily exist in the context of a pandemic which is in fact caused by human beings carrying virus in their respiratory system arguably without any physical flow of particles. As such, more thorough analyses should be conducted to confirm state responsibility for the COVID-19 spread under international law, going beyond simply pinpointing China as the originating country and as the country with loose initial responses. Once the current pandemic is brought under control, debates on state responsibility based on international law jurisprudence will likely be conducted. Sound legal bases should guide these debates.
