5G의 새로운 기술은 주파수를 기존과는 다른 방법으로 더 효율적으로 사용할 수 있는 가능성을 열어 놓았으며 다양한 산업분야에 접목되어 5G 버티컬이라는 새로운 가치를 만들어내고 있다. 이러한 기술적 추이에 맞추어 해외 각국에서는 주파수를 통신사업자가 아닌 일반 개인 및 기업에게 주파수를 이용할 수 있게 하고, 자신의 기지국을 설치하는 5G 특화망의 도입 논의가 활발하게 진행되고 있다. 우리 정부도 2021년 1월 26일 「5G 특화망 정책방안」을 통해 다양한 사업자가 5G 시장에 참여 할 수 있는 기반환경을 조성하기 위해 5G 특화망을 도입할 것을 발표하였고, 6월 29일 그 후속으로 「5G 특화망 주파수 공급방안」을 발표한 바 있다. 이 논문은 이동통신시장에서 어떻게 기존과는 다른 주파수 이용환경이 만들어졌으며, 새롭게 대두된 5G 특화망에 대한 설명과 등장배경을 법학에서 접근할 수 있도록 제시하였다. 전파는 모든 ICT의 근간이 되는 중요한 자원임에도 불구하고 이를 관리하는 전파관련 법제는 전파를 이용한 다른 ICT 법제에 비해 많은 연구대상이 되지 못하고 있다. 특히 그 동안의 전파관련 법제는 초기부터 통신사업자의 서비스 제공과 소비자인 이용자 보호를 근간으로 마련되어 왔기 때문에 전혀 다른 차원의 전파이용이 예상되는 5G 특화망을 도입하기 위해서는 관련 법제도의 개선이 필요하지만 이에 대한 논의는 주로 공학 쪽에서 다루어 질뿐 법학에서는 활발하게 이루어지지 못하고 있는 실정이다. 이에 이 논문에서는 우리나라에서는 5G 특화망이라고 명명되는 로컬 5G에 대해서 기본적인 설명과 함께 5G 특화망의 도입을 위한 전파법 개정방안을 제시해보고자 하였다.
Abstract
5G is projected to become the primary communications network within cities and countries. With 5G moving from ‘blueprint’ to reality, countries have begun to look at how this new technology can be used to drive innovations across industries and have started to deploy local 5G. Local 5G is a private network which uses 5G technology with dedicated bandwidth and infrastructure. Various countries have already offered licensed 5G bands directly to private companies so they can better prepare their infrastructures according to their constituents. The South Korean mobile market is dominated by three fixed mobile network operators and almost all radio frequency regulations and policies have been drafted around these three main operators. Although it is widely predicted that local 5G will become more prevalent than any other private network, little attention has been given on its significance until now. This paper discusses the characteristics of local 5G to aid in the understanding of the concept. It analyzes how new mobile technology changes the operator-oriented market structure and suggests a few revisions for the Radio Wave Act that are not suitable for local 5G deployment.
