의료 인공지능의 법적 수용을 위한 시론적 연구 - 쟁점과 과제 -

초록
의료는 4차 산업혁명 시대의 핵심기술들이 결합되는 대표적인 분야로 이해된다. 최근 의료분야에서는 인공지능은 물론 사물인터넷, 빅데이터, 클라우드 등 지능정보기술의 활용이 급속히 증대되고 있다. 본 논문에서는 의료 인공지능의 개발에 있어 선재적이고 필수적으로 요청되는 의료 데이터의 고유한 특성을 살펴보고, 의료 빅데이터를 활성화시키는 데 있어서 현재 직면하고 있는 난제들과 이를 해결하기 위한 정책적 과제들을 제시한다. 또한 의료법상 의료행위에 대한 해석 관점에서 의료 인공지능의 행위를 법적으로 어떻게 평가할 수 있을지 검토하고, 의료 인공지능이 개입된 의료사고가 발생하였을 때 의료과실에 대한 책임귀속의 문제를 (특히 의료인의 주의의무와 관련지어) 분석한다. 나아가 의료 인공지능이 활용됨에 따라 의사와 환자 간의 상호적인 관계는 어떻게 변모해갈 것인지, 의료인에게 요청되는 새로운 역량은 무엇인지, 이에 따라 의료 인력에 대한 수요 및 의료인을 양성하는 교육체계는 어떠한 변화를 경험하게 될지 등을 비롯해, 의료 인공지능의 활용에 따른 의료현장에서의 구체적인 변화 양상을 전망해본다. 마지막으로 바람직한 의료법정책의 방향성을 모색하는 데 있어서 함께 고려되어야 할, 의료분야에서 인공지능이 도입 및 수용됨에 따라 제기될 수 있는 윤리적 쟁점들을 정리하면서 논의를 마무리한다.
Abstract
This paper examines the unique characteristics of medical data that are prerequisite and required for the development of artificial intelligence in medicine, and discusses the challenges we are currently facing in activating medical big data and some relevant legal policies to overcome those problems. Furthermore, the paper examines certain practice of medical AI to legally evaluate it from the interpretation of medical practice in existing medical law, and analyses the issue of liability for medical malpractice involving medical AI. In addition, the paper looks into the specific changes in the medical field according to the use of medical AI, including the doctor(physician)-patient relationship, new skills and capabilities of medical personnels, and medical education. Finally, the discussion concludes with a summary of the ethical issues that may arise as AI is introduced and adopted in medicine and healthcare, which should be considered in devising and delivering sustainable medical legal policies in this intelligent information society.
