2020년 개정 형법 제33조와 소극적 신분

초록
신분이 범죄의 성립 여부나 법정형의 경중을 좌우하는 경우 그런 범죄를 신분범이라고 한다. 이런 신분을 적극적 신분이라고 한다. 이와 달리 신분이 범죄의 성립을 부정하게 하는 경우 그런 신분을 소극적 신분이라고 한다. 판례는 현행 형법 제33조가 말하는 신분에는 적극적 신분은 물론 소극적 신분도 포함된다고 본다. 2020. 12. 8. 형법 개정의 취지는 용어 순화에 있었다. 그러나 그 취지와 달리 형법 제33조의 해석에 영향을 미쳤다. 개정 형법 제33조가 규정하고 있는 신분에 소극적 신분도 포함된다고 보기는 어렵게 되었다. 그렇다고 소극적 신분자가 비신분자의 범죄에 가담한 경우 그 소극적 신분자를 처벌할 수 없는 것은 아니다. 소극적 신분범에 대해서도 공범종속성원칙과 공동정범의 기능적 범행지배원칙이 적용되기 때문이다. 또한 의료법에는 의료인이 아닌 자에게 의료행위를 하게 하는 범죄가 신설되었다. 비신분자가 소극적 책임신분자에게 범인도피죄를 교사한 경우 비신분자에게 범인도피죄의 교사범이 성립하는지 여부는 비신분자가 본범인지 여부에 따라 달리 검토할 필요가 있고, 본범인 경우에는 범인도피죄의 교사범을 부정함이 옳다고 본다. 이 경우 범인도피죄는 필요적 공범으로 볼 수 있기 때문이다.
Abstract
There are crimes whose status constitutes a crime. This is the case for bribery of public officials. There are also crimes where status affects the severity of punishment. This is the crime of perpetual murder. These crimes are called status crime, and these statuses are called constitutive status. On the other hand, there are cases where the establishment of a crime is denied due to status. Such status is called negative status. The purpose of the amendment of the Criminal Act on December 8, 2020(hereinafter referred to as the 2020 revised criminal act) was to purify legal terms. However, contrary to its purpose, it influenced the interpretation of Article 33 of the 2020 revised criminal act. It has become difficult to interpret that the status of Article 33 of the 2020 revised criminal act includes negative status. However, if a negative status person participates in a crime of a non-status person, the negative status person can be punished. And in the medical service law, a crime was newly established that caused unlicensed persons to conduct medical services.
