구심적 연방주의의 개념과 기준

연방주의는 연방구성단위체(비중앙단위, 연방구성국가)의 자치를 향한 원심력과 연방단위체(중앙단위, 연방국가)의 공치를 향한 구심력이 균형을 이루는 동태적 과정 속에서 형성된다. 이러한 연방주의는 다양한 스펙트럼을 가지게 된다. 시민이 주민과 국민의 이중의 소속을 동시에 갖는 민주적 연방주의는 주권론의 관점이 아니라 헌법에 의하여 제도화된다. 이러한 입헌주의적 연방주의의 특징은 다음과 같다. 헌법상 기구로서의 연방구성단위체의 존재, 이러한 연방구성단위체에 대한 헌법상 자치의 보장, 권력의 연방적 배분과 재정상의 자율, 그리고 연방적 분쟁에 대한 해결 메커니즘이 있어야 한다. 연방정치체제는 집권-분권의 논리가 아니라 비집권화(non-centralization)의 논리에 의해 권위의 집중을 각 장으로 분산하는 문제해결단위를 형성한다. 이러한 비집중화의 구조는 종종 분권화와 혼동되어 사용되기는 하지만, 다극의 중앙을 형성하는 연방정치체제는 하나의 극점을 설정하게 되는 집권화의 논리와 같은 차원이라고 할 수는 없다. 이처럼 집권-분권의 논리로 연방정치체제를 분석하는 것이 개념적으로 불충분한 지점이 있는바, 본 논문은 정치의 구심력이 강하게 나타나는 연방주의, 즉 단방제와 유사한 형태의 중앙집중형 연방주의가 나타나는 양태를 구심적 연방주의라 명명하고, 그 특징과 형성조건 등을 연구하는 것을 목적으로 한다. 이렇게 정치의 구심력과 원심력을 부등호로 표현하게 될 경우 연방주의의 동태적 개념이 더욱 잘 드러날 수 있다.
Abstract
Federalism is the balance between the centrifugal force toward autonomy of the constituent unit and the centripetal force towards the shared-rule of the general government. In this dynamic process, federalism portrays the spectrum(column). Democratic federalism, which has dual affiliation of residents and citizens at the same time, is institutionalized by the Constitution, not by the sovereignty theory. The characteristics of this constitutional federalism are as follows: the existence of the constituent unit as a constitutional body; the guarantee of constitutional autonomy for this constituent unit; the federal distribution of power; financial autonomy; and a mechanism for resolving federal disputes. The federal political system does not fit into the centralization-decentralization. Rather it forms a problem-solving unit that disperses the concentration of authority to each arena, that is non-centralization. Although non-centralization is often confused with decentralization, the federal political system that has a multi-polarity center cannot be said to be on the same level as the centralization logic which sets only one pole. Analyzing the federal political system with the centralization-decentralization logic is conceptually inaccurate. This paper focuses on federalism with a strong centripetal force in politics, which is, similar to a unitary system, and suggests calling it ‘centripetal federalism’. Further, this paper studies its characteristics and the forming condition. If we express federalism as an inequality sign of centripetal and centrifugal force, the dynamic of federalism can be revealed more clearly.
