초록
이 논문의 제목은 “인공지능 기술의 발전과 부동산의 감정평가”이라고 정하였다. 토지수용절차에서는 토지의 감정평가가 필연적으로 이루어진다. 토지소유권은 헌법에 의하여 보장받는 기본권으로서 일반 사인이 사용, 수익, 처분권능을 자유롭게 행사 할 수 있는 것이 원칙이다. 그런데 현행 헌법은 일반 사인의 토지소유권을 절대적으로 보호하고 있는 것은 아니며, 예외적으로공공의 목적 내지 필요성이 있는 경우에는 당해 권리가 제한될수 있으며, 다만 그에 상응하게 정당한 보상을 지급하도록 관련규정을 마련하고 있다. 그런데 실제 토지소유권의 수용과정에서소유자들은 대부분 보상금의 액수가 적절하지 않다는 주장을하는 경우가 적지 않다. 한편, 최근에 인공지능기술이 빠르게발전하고 있으며, 다양한 영역에서 활용되고 있다. 이러한 인공지능기술을 활용하게 된다면 토지수용절차에서 보다 정확하게보상금이 지급될 수 있을 것으로 보인다. 왜냐하면 인공지능기술을 활용하게 된다면 보상금 결정에 있어서 중요한 비교표준지의 선정이 보다 정확하게 이루질 개연성이 높기 때문이다.
Abstract
The title of this thesis is ‘Advances of Artificial Intelligence Technology and Appraisal for Real Estate’. In the land expropriation procedure, appraisal of land is inevitably performed. Property rights are fundamental rights guaranteed by the Constitution. However, property rights are not absolutely protected. Property rights are limited by public needs, but there must be fair compensation. However, in the expropriation procedure of land, Landowners raised many objections to the compensation. Landowners claim that compensation is low. In recent years, artificial intelligence technology is advancing rapidly. Artificial intelligence technology is being used in various fields. In the land expropriation procedure, the adequacy of compensation is an issue. If artificial intelligence technology is used, compensation can be paid more accurately. If artificial intelligence technology is used, the selection of comparative standard land can be made accurately.
