캐나다 소년형사사법에서의 피해자의 법적 지위

초록
국가마다 형사 또는 소년사법의 역사, 문화가 다르고 그 구조가 상이하여 특정 국가의 제도가 일률적으로 타당하다고 볼 수는 없다. 하지만 지역을 막론하고 법익 침해로 인하여 형사절차가 진행되고, 적어도 개인적 법익의 경우 법익의 주체인 개별 피해자가 존재한다는 점은 차이가 없는 공통된 사실이다. 따라서 개별 사법체계의 구조와 상관없이 법익 침해의 문제를 해결하는 과정에서 피해자의 목소리를 반영하는 것은 어쩌면 당연한 일이고, 그것이 유엔 범죄피해자인권선언의 취지이기도 하다. 전체 소년법 체계 내에서 피해자를 어떻게 취급하고 어떠한 법적 지위를 부여할지에 대한 논의에 큰 진척이 없는 상황에서 캐나다의 법제도에 대한 검토는 우리나라의 제도 설계에 있어 많은 시사점을 제공해 줄 수 있다. 캐나다는 세계적으로도 피해자의 관점을 소년형사사법체계에 반영하고 관련 제도를 구현한 나라로 유명하기 때문이다. 본고에서는 우리나라에서의 관련 논의를 위한 기초자료를 제공하는 것을 목적으로, 캐나다의 소년형사사법절차를 개관하고, 범죄피해자 권리장전의 내용을 살펴본 다음, 소년형사사법절차에서의 피해자의 역할 및 지위를 검토하여 그 시사점을 도출하였다.
Abstract
Since the history and culture of youth justice differ from country to country, it is not considered that the system of a particular country is uniformly valid. However, there is no difference in the fact that youth criminal procedures proceed due to infringement of legal interests, and that individual victims are suffering from such crimes. Therefore, regardless of the structure of the individual judicial system, it is natural to reflect the victim’s perspective in youth criminal justice. Nevertheless, there has been little progress in discussions on how to treat victims and what legal status they will be granted within the entire youth justice system in Korea. Under these circumstances, a review of Canada’s legal system can provide many implications, as Canada is famous worldwide for reflecting the victim’s perspective in Youth Criminal Act and implementing related systems. In this paper, to provide information for related discussions in Korea, I introduced the youth criminal justice system in Canada and examined the contents of the Canadian Victims Bill of Rights. Based on this, I derived the implications by examining the role and status of victims in youth criminal justice.
