남북한 교육 분야 법･제도의 통합 試論

This study aims to examine the basic directions and processes of the legal integration of the South- and North Korean educational system applied in the German unification, which determines the pros and cons that have been brought about. In the internal and external changes, Kim Jong Eun regime has attempted to integrate through collective consciousness and norms, political and cultural symbols and discourses, mass media and administrative organizations. North Korea focuses on maintaining cultural ties through education, and has a systematic capacity for integration, regulation and symbolism. North Korea shares national values and repeated idolization of the Kim Il Sung family via its education system. Despite Kim Jong Eun’s attempt to reform education, integration efforts through education still continue. The changes through the integration of educational system are characterized by the closure of many educational institutions, introduction of new system and new school/university types, maintenance of some systems in North Korea. Changes in the new area of unified Korea will also influence the area of South Korea’s education as well. Hence, we must find a suitable South- and North Korean educational integration for the stability. Through the past experience of German unification, it is firstly achieved to lay a theoretical foundation for making plans for an integrated educational system. The subject matter about the teacher integration should also be given a thorough concern. The unified Korean government must decide to partially eliminate the ones who are proven not pertinent to a new educational environment in a unified Korea. Whereas, those who are allowed to continue their position as teachers in a unified Korea should be required to receive reeducation to adapt to a new democratic educational institution. It can be concluded in this research that the new democratic educational system must be established so fast in North Korea through the integration of educational systems. To admit is that the process of integration will bring numerous legal issues if sufficient amount of discussion and agreements do not follow. Therefore, we can draw some suggestions for unification education in unified Korea. The need of agreement on educational competency between the central government and regional superintendent of education, revitalization of exchange and cooperation between South- and North Korea, education for details about the process of educational integration in Germany.
